TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the
authority vested in him by that certain Deed of Trust,
dated September 4, 2024, and duly recorded in the
Office of the Clerk of the County Commission of Wetzel
County, West Virginia, in Document No. 375827, in
Book No. 460, at Page 564, and modified by Corrective
Affidavit recorded on February 24, 2026 in Book 468,
Page 146, Christopher Gage Potoczny did convey unto
Kyle A Elliott, Attorney at Law, Trustee(s), certain real
property described in said Deed of Trust; and the
beneficiary has elected to appoint Seneca Trustees,
Inc., as Substitute Trustee; and default having been
made under the aforementioned Deed of Trust, and the
undersigned Substitute Trustee having been instructed
by The Huntington National Bank to foreclose
thereunder, will offer for sale at public auction at the
front door of the Wetzel County Courthouse in New
Martinsville, West Virginia, on
May 8, 2026 at 1:30 PM
the following described real estate, together with its
improvements, easements and appurtenances
thereuntom belonging, situate in 08 – Magnolia District,
Wetzel County, West Virginia, and more particularly
described as follows:
The following described property, with the
appurtenances thereunto belonging, lying and being in
Van Camp Heights, Magnolia District, near the Town of
Paden City, Wetzel County, West Virginia, and more
particularly described as follows:
FIRST: A parcel of land, Lot No. 6 of the VanCamp
Heights, Padens Valley, Magnolia District, Wetzel
County, West Virginia in said Paden City, more
particularly described as follows:
BEGINNING at a 1″ iron pipe in the NE corner of Lot
No. 5, Charles M. Bayes property, and the NW corner of
Lot 6 and 375′ from the intersection of 7th Avenue and
Harrison Alley and the NW corner of Lot 1; thence with
Lot 6 and S. 53 30′ E 75′ to a 1″ iron pipe, the NE corner
of Lot No. 6 and S 53 30′ W, 45.15′ from an existing 2″
iron pipe in the L. McIntyre property; thence with
the L. McIntyre line, S 28 30′ E 218.4′ to a 1″ iron pipe,
the SE corner of Lot No. 6 and the common corner L.
McIntyre and G. Bridgeman property; thence with the
line between G. Bridgeman and Lot No. 6 S 53 30′ W
75′ to a 1″ iron pipe the SW corner of Lot No 6 and SE
corner of Lot No. 5 and in the G. Bridgeman line; thence
the Charles M. Hayes line of Lot No. 5, N 28 30′ W
218.4′ to the point of beginning, containing 16,221
square feet (0.37 acre) more or less, as surveyed by C.
A. Smith of Paden City, West Virginia, and shown on
Plat No. 273, Rev. 1.
SECOND: An easement of right of way for a water line
to serve Lot No. 6 and described as follows:
BEGINNING at a 1″ iron pipe 2′ from a 24″ poplar, the
NW corner of Lot No. 11, the SE corner of intersection
of Harrison Alley and Sixth Avenue of the Alexander
Addition of Paden City, thence with the line of Harrison
Alley and Lot No. 11 N 28 30′ W. 4′ to the center line of
10′ right of way; thence through the N section of Lot
No. 11 with the center line of 10′ right of way, N 80 30′
E. 55′ to a point in Lot No. 11; thence SE with the center
line of 10′ S 41 E 203′ to a point in the S Boundary line
of Lot No. 10 and 3′ E of a 1″ iron pipe, the S common
corner of Lots No. 11 and No. 10 and the 40′ private
road right of way; thence with the private road right
of way, N 53 30′ E to Lot No. 6, this being a common
right of way for the water system as surveyed by C. A.
Smith of Paden City, West Virginia, and shown on Plat
No. 273, Rev. 1.
THIRD: An easement for sewer line to serve said lot
and described as follows:
BEGINNING at a 1″ iron pipe 2′ from a 24″ poplar the
NW corner of Lot No. 11 and the SE corner of
intersection of Harrison Alley and Sixth Avenue of the
Alexander Addition to Paden City; thence with the E line
of Harrison Alley and Lot No. 11 S 28 30′ E 4′ to
the center line of right of way; thence through the N
section of Lot No. 11 with the center line of 10′ right of
way, N 80 30′ E. 68 feet to a point in the line between
Lot No. 10 and No. 11 and 31′ from a 1″ iron pipe and
the NE corner of Lots No. 10 and 11; thence through Lot
No. 10 and No. 9 with the center of 10′ right of way, N
64 30′ E, 150′ to a concrete block manhole 52′ SE of a
1″ iron pipe the common N corner of Lots No. 9 and No.
8; thence SE through Lot No. 8 with 10′ right of way
parallel with the line between Lots No. 9 and No. 8 and
5′ to the E S 47 28′ 20″ E 170′ to the 40′ private road
right of way; thence SE through the 40′ private road right
of way to Lot No. 6; this being a common right of way for
the sanitary system as surveyed by C. A. Smith of
Paden City, West Virginia, and shown on Plat No. 273,
Rev 1.
FOURTH: An easement of right of way over that certain
private road being 40 feet wide which commences at the
intersection of Harrison Alley and Seventh Avenue and
runs in front of Lots 1 through 6 inclusive, as the same
are shown on the abovementioned C. A. Smith Plat No.
273. The aforesaid C. A. Smith Drawing No. 273 has
been recorded in the Wetzel County Clerk’s Office in
Plat Book 4, at page 65, and references here made to
said plat for a more particular description of said
properties and easements.
Being the same property conveyed unto Christopher
Gage Potoczny by Richard K. Long, II and Megan R.
Long, husband and wife, by Deed dated the 28th day of
August, 2024, which said Deed shall be recorded
simultaneously with this instrument in the office of the
Clerk of the County Commission of Wetzel County,
West Virginia. This conveyance is made subject to any
and all exceptions, reservations, restrictions and
conveyances heretofore given, leased, reserved and
excepted by the Grantor and his predecessors in title.
At the time of the execution of the Deed of Trust, this
property was reported to have an address of: 814 N 7th
Ave, Paden City, WV 26159.
The referenced real estate will be conveyed with no
covenants of warranty, and subject to all covenants,
restrictions, easements, rights of way and reservations
which may be a matter of record in the aforesaid Clerk’s
Office or visible upon the ground, all prior liens and
encumbrances, including, without limitation, liens for
real estate taxes, incinerator, sanitary and sewer
charges. The purchasers at the sale shall be
responsible for paying the recording costs and also the
tax on the privilege of transferring real property (the cost
of the tax stamp to be affixed to the deed). The
purchasers shall be responsible for payment of all real
estate taxes.
The subject property will be sold in “AS IS” condition.
The Substitute Trustee shall be under no duty to cause
any existing tenant or person occupying the subject
property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as
deposit at the time of sale with the balance due and
payable within 30 days of the day of sale. Sale is also
subject to buyer providing Trustee with information
needed for reporting requirements required by Federal
Law including FinCen requirements (31 CFR Chapter X)
within 15 days from date of sale.
FEDERAL TAX LIEN: In the event that there are
Federal Tax Liens against the property, the United
States would have the right to redeem the property
within a period of 120 days from the date of such sale or
the period allowable for redemption under local law,
whichever is longer.
Pursuant to the Deed of Trust, the Trustee may
postpone the sale by public announcement at the time
and place designated or by posting a notice of the
same, and act by agent in the execution of the sale.
The parties secured by the Deed of Trust reserve the
right to purchase the property at such sale.
