NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 26, 2023, executed by Borrower(s), Ervin A. Crim Sr, to Terry D. Reed, the Trustee of record in the office of the Clerk of the County Commission of Upshur County, West Virginia, in Book 661, at Page 303. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 53 Orr St, Buckhannon, WV 26201. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 13, 2026, of record in the Clerk’s Office in Book 684, Page 356. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Upshur County, in Buckhannon, West Virginia, on the following date: 1st day of May, 2026 at 11:30 a.m. All that certain tract, lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, including any manufactured structures, mobile homes, double wide or modular homes, situate in Buckhannon District, Upshur County, West Virginia, and being more particularly bounded and described as follows: Being Lot No. nine (9) as the same is shown and delineated upon a plat entitled “Armory Addition” which said plat appears of record in the Office of the Clerk of the County Commission of Upshur County, West Virginia, in Plat Book No. 2 at page 59, said Lot fronts sixty (60) feet on Orr Street and extends back there from in uniform width a distance of one-hundred twenty (120) feet. The property herein described is the same tract conveyed to Robert S. Sprouse and Amanda Yvonne Sprouse by Clinton E. Wyatt, by deed dated August 2, 2017, and recorded in the Office of the Clerk of the County Commission of Upshur County, West Virginia in Deed Book 545 at page 402. Subsequently by deed dated June 7, 2023, and recorded on June 27, 2023, in said Clerk`s Office in Deed Book 597 at page 33, Robert S. Sprouse and Amanda Yvonne Sprouse conveyed the subject property to Ervin A. Crim, Sr. There is excepted and reserved from the aforesaid property all of the coal, oil and gas in, upon and underlying the same together with the necessary mining and removal rights, as the same have heretofore been excepted and reserved or conveyed away by the present or former owners. This conveyance is made subject to all existing reservations, restrictions, exceptions, conditions, easements, rights of way or other servitudes, if any, made, reserved or created in prior deeds of record in said Clerk`s office, or which would be disclosed by a visual inspection of the premises. For the stated consideration, the Grantor does further grant and convey unto the Trustee all rights of way and easements, together with all appurtenances pertaining to the aforesaid real estate, whether presently owned or hereinafter acquired, which are matters of record in said Clerk`s office or otherwise. In the event the property described herein is subject to any other trust deeds securing the secured party herein, at the election of the secured party, default under any of said trust deeds shall constitute default under all trust deeds. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) Pursuant to the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements. 7) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
