PUBLIC HEARING NOTICE
In accordance with Chapter 8A, Article 5, Section 8 of the Code of West Virginia 2004, as amended, the Berkeley County Planning Commission will hold a public hearing to consider the public comments on the following projects:
REQUEST FOR DETAILED SITE PLAN APPROVAL: District Concrete: The site is located on the west side of US Route 11 approximately 1.4 miles north of the Virginia state line and 0.5 miles south of Sam Mason Road, in the Mill Creek Tax District. The project proposes a material storage facility for a concrete delivery service, on 1.10 acres. To be served by public water and septic. File# 2412-400
REQUEST FOR FINAL PLAT APPROVAL: Boyd’s Crossing Phase 1, Section 3A- Lots 10-13: The project is located south of the intersection of Runnymeade Road (WV Rt. 26) and Soldier Drive, in the Mill Creek Tax District. The Final Plat proposes four (4) lots on 127.57 acres, to be served by public water and sewer. File# 2601-029
REQUEST FOR WAIVER: Chris Jones Family Transfer: The site is located at 875 Abe Myers Road, approximately ¾ of a mile from Back Creek Valley Road (WV Rt. 7), in the Hedgesville Tax District. The developer is requesting a waiver to Section 302.1.D.1, of the Subdivision and Land Use Ordinance (2025), requiring a 50′ right-of-way from the proposed family transfer lot(s) to a WVDOH right-of-way. REQUEST FOR WAIVER: Kevin L. & Gerald L. Butts: The site is located at 6759 Tuscarora Pike (CR 15), approximately 0.45 miles west of its intersection with Poor House Road (CR 45/8), in the Hedgesville Tax District. The developer is requesting waivers to the following Sections of the Subdivision and Land Use Ordinance (2025): Section 302.1.D requiring a 50′ right-of-way to a WVDOH maintained road for Administrative subdivisions & Table 5-6 requiring 60,000 square feet for residential lots served by private well and septic. The PUBLIC HEARING will be held on Monday, May 4, 2026, in the County Commission Chambers, 400 West Stephen Street, in the City of Martinsburg at 6:00 p.m. All persons and agencies having an interest on said plats are invited to participate in this hearing and make their comments known.
In the event that an unforeseen circumstance would cause the Planning Commission to cancel the scheduled meeting, a back-up public hearing date Monday, May 18, 2026 will be utilized.
