By virtue of that certain Deed of Trust made by Laurie O. Glenz, to John E. Gompers, Trustee, dated the 18th day of June, 2019, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1584, at page 191, and that certain Appointment of Successor Trustee, dated the 11th day of December, 2019, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1595 at page 75, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 30th day of January, 2020, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, the following described property (“Property”) situate at 27 Lynwood Avenue, Wheeling, Ohio County, West Virginia 26003, and being more particularly described as follows:
The following piece or parcel of land situate in the City of Wheeling, County of Ohio, and State of West Virginia, and more particularly described as follows:
Commencing at a point in the east line of Lynn Avenue and Ten (10) feet in a southerly direction from the corner to Lots Numbered Forty-Five (45) and Forty-Six (46) in Birch Lynn Addition to Edgewood, Triadelphia District, Wheeling, Ohio County, West Virginia, thence in a southerly direction and with the west line of said Lot Numbered Forty-Six (46) a distance of Fifty-Two and Twenty – Two Hundredths (52.22) feet to the corner of Lynn Avenue and Edgington Lane; thence in an easterly direction and along the north side of Edgington Lane a distance of One Hundred and Sixteen and Twenty-Three Hundredths (116.23) feet to Koller Lane; thence in a northerly direction and along the west line of said Koller Lane, a distance of Thirty-Five and Forty-One Hundredths (35.41) feet; thence in a westerly direction and parallel with the division line between said Lots Forty-Five (45) and Forty-Six (46) a distance of One Hundred and Fifteen (115) feet to the place of beginning. The intention being to convey all of the Lot Numbered Forty Six (46), excepting the northerly Ten (10) feet in said Birch Lynn Addition, the plat of which addition being duly of record in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book No. 2, Page 5.
And the said parties of the second part, for themselves, their heirs and assigns, hereby covenant with the said parties of the first part, their heirs and assigns, that they will not erect or cause to be erected upon the property herein described and conveyed, within the space between the front line and the building line, as shown on said plat, any building whatsoever, excepting an open porch, veranda or stoop, and further that no residence or other structure shall be erected the cost or contract price of which shall be less than Three Thousand Dollars ($3,000.00), excepting however, the necessary outbuildings and further, that the main building shall be for residence purposes only.
This conveyance is further made subject to all restrictions, reservations, rights of way and exceptions contained in prior Deeds of Conveyance and subject thereto, the parties of the first part hereby covenant with the said parties of the second part that they will warrant GENERALLY the property hereby conveyed.
Grantors have no actual knowledge or reason to believe that the property, the substrata or subsurface of the property has been used for storage, treatment or disposal of hazardous waste, or contains any underground storage tank or tanks.
BEING the same property that was conveyed to Alfred J. Glenz and Laurie O. Glenz, husband and wife, by James A. Jaeger and Rita M. Jaeger, husband and wife, by Deed dated the 11th day of January, 2002, and recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 731, at Page 677.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
