To the above-named Defendant, Perry F. Davis:
Pursuant to Rule 4(e)(1) of the West Virginia Rules of Civil Procedure concerning service by publication, and upon the previous filing of an affidavit with the Clerk’s office in this matter, it is hereby ORDERED as follows.
1. The style of this action is Mountain Lake Landscaping, LLC v. Perry F. Davis and Michele R. Edwards., civil action no. 25-C-303 in the Circuit Court of Berkeley County, West Virginia. The Defendant to be served by publication is Perry F. Davis.
2. The object of the suit is to seek judgment and damages for the Plaintiff due to alleged breach of contract, quantum meruit/implied contract, promissory estoppel and unjust enrichment. Plaintiff also seeks enforcement of a lien. This matter arises out of work performed by the Plaintiff on the Defendants’ property at 627 Hammonds Mill Road, Hedgesville, WV 25427.
3. Plaintiff’s attorney is Alex A. Tsiatsos and his address is 142 North Queen Street, Suite 210, Martinsburg, WV 25401.
4. A copy of the complaint may be obtained from the Clerk.
5. Defendant Perry F. Davis must appear and defend on or before the following date: May 20, 2026 (which shall not be fewer than 30 days after the first publication of this order). Otherwise, judgment by default will be rendered against the Defendant at any time thereafter.
