TRUSTEE'S SALE OF

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 9, 2022, and duly recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Document No. 864955, in Book No. 1451, at Page 215, Zachary Dewayne Dotson did convey unto Andrew C Skinner, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank, to foreclose thereunder, will offer for sale at public auction at the front door of the Mercer County Courthouse in Princeton, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Bluefield District, Mercer County, West Virginia, and more particularly described as follows:

All of those certain lots or parcels of real estate situate near the City of Bluefield, in the Beaver Pond District, in Mercer County, West Virginia, which lots or parcels of real estate are further described as follows:
First:
Lot No. 195 of the Cumberland Heights Addition to said City, as shown upon a revised plat of record in the County Court Clerk's Office of Mercer County, West Virginia in Map Book No. 2, at page 141, which lot is more particularly described as follows: Beginning at a point in the western line of the West Virginia State Highway right of way, shown on said map as the Grassy Branch cut-off, said beginning point being located 731.36 feet distant from the point of intersection of the western line of said State Highway with the southern line of Sunrise Drive and in a southeasterly direction therefrom, which beginning point is the southeastern corner of Lot 194; thence from said beginning point along the southern line of Lot 194, S 70° 56 W, 165.27 feet to a point; thence S 15° 45' E, 75 feet to a point, the northwest corner of Lot 196; thence along and with the northern line of Lot 196, N 70° 56' E, 179.86 feet to a point in the western line of the Grassy Branch cut-off; the northern corner of Lot 196; thence along the western line of the said State Highway, N 20° 40' W, 10.9 feet to a stake; thence continuing with the western line of said State Highway in a southwesterly direction 5.0 feet to a stake; thence still continuing along the western line of said State Highway N 24° 05' W, 59.74 feet to the beginning.

Lot No. 194 of the Cumberland Heights Addition to Saw City, as shown upon a revised plat of record as aforesaid in Map Book No. 2, at page 141, which lot is more particularly described as follows: Beginning at a point in the western line of the West Virginia State Highway known as Grassy Branch cut-off, S 25° 48' E, 619.9 feet; S 24°05' E, 45.8 feet from the intersection thereof with the south line of Sunrise Drive; thence along said right of way, S 24° 05' E, 68.66 feet to a point; thence S 70° 56' W, 165.27 feet to a point; thence N 15° 45' W, 70 feet to a point; thence N 70° 56' E, 155.55 feet to the beginning.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 2606 Grassy Branch Rd, Bluefield, WV 24701-5139.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk's Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
