NOTICE OF TRUSTEE’S SALE
Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Regina G. Sanders, to Michael L. Solomon, Trustee(s) dated July 30, 2014, and recorded in the office of the Clerk of the County Commission of Monongalia County, West Virginia, in Trust Deed Book 2015, at page 281 and re-recorded in Trust Deed Book 2065, at page 546, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee recorded March 11, 2025, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on April 30, 2026 at 5:32 p.m., at the front door of the courthouse of Monongalia County, West Virginia, the real estate conveyed by said deed of trust and situate in Morgan District, Monongalia County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 1083 Brookings Drive, Morgantown, WV 26508 and being more particularly bounded and described therein as follows:
All of that certain lot or parcel of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in the Morgan District, Monongalia County, West Virginia, and being more particularly bounded and described as follows:
All of Lot No. 81, Westbrook Heights Addition, as laid down and designated upon a plat dated March 24, 1993, prepared by Frank W. Williams, R.P.E. No. 7064, of Williams Engineering Company, and more particularly bounded and described as follows: Beginning at an iron pin on the northwestern right of way line of Brookings Drive, (formerly Brookhaven Drive), a forty (40′) foot street, corner to lands of Selba Corporation; thence with said Brookings Drive right of way line, S. 63 degrees 46′ W. 92.83 feet to an iron pin at the intersection of said Brookings Drive and the eastern right of way line of Bennett Drive right of way line, S. 63 degrees 46′ W. 92.83 feet to an iron pin at the intersection of said Brookings Drive and the eastern right of way line of Bennett Drive, a forty (40′) foot street; thence with said Bennett Drive right of way line with a curve to the right, radius = 25.00′, arc length = 44.95′ to an iron pin; thence by same, N. 13 degrees 13′ W. 76.33 feet to an iron pin corner to Lot 80; thence with Lot 80, N. 63 degrees 46′ E. 100.00 feet to said Selba Corporation lands; thence with Selba Corporation lands, S. 26 degrees 14′ E. 105.00 feet to the point of beginning, containing 11,550 square feet (0.2652 acres).
Being the same real estate conveyed to Kevan A. Damm and Cara N. Damm, husband and wife, from Scott A. Shirey and Andrew N. Shirey, husband and wife, by deed dated the 21st day of July, 2004, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1279, at page 149, to which deed and aforesaid plat reference is here made for all pertinent purposes.
Being the same real estate conveyed to Regina G. Sanders from Kevan A. Damm and Cara N. Damm by deed dated July 29, 2014, recorded in the aforesaid Clerk’s Office in Deed Book 1502, at page 330
And being the same real estate conveyed to Matthew Paul Chisler and Cassy Nicole Goodwin from Regina G. Sanders by deed dated January 19, 2021, recorded in the office of the Clerk of the County Commission of Monongalia County, West Virginia in Deed Book 1764, at page 470.
Further granted and conveyed the right to use Bennett Drive and the other roadways in Westbrook Heights Addition for the purpose of connecting to, installing, servicing, and repairing telephone, electric, gas, water, sewer and television cable lines and pipelines, and for vehicular and pedestrian ingress, egress, and regress.
Further subject to a 5-foot utility easement along the entire perimeter of said lot as shown upon plat recorded in Deed Book 1159, at page 307.
Further subject to prior reservation of all minerals, coal, oil and gas, together with mining rights and drilling rights appurtenant thereto, and to all reservations, rights of way, easements, covenants, and conditions.
This Deed is made subject to all restrictions and reservations contained in prior deeds of record in which reference is here made for all pertinent purposes.
This conveyance is made subject to all exceptions, reservations, restrictions, conditions, easements and rights of way as contained in prior deeds of record for this chain of title.
This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.
The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.
The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
TERMS OF SALE: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of the sale.
