NOTICE OF TRUSTEE'S SALE

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by John Martin Dolog, to Merendino Law, PLLC, Trustee dated July 29, 2022, and recorded in the office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 1307, at page 485, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated February 4, 2026, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on April 30, 2026 at 4:40 p.m., at the front door of the courthouse of Marion County, West Virginia, the real estate conveyed by said deed of trust and situate in Paw Paw District, Marion County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 157 Skyline Drive, Rivesville, WV 26588 and being more particularly bounded and described therein as follows:

All of the following described lots or parcels of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate, and being in Paw Paw District, Marion County, West Virginia, more particularly bounded and described as follows, to-wit:

LOT ONE, SECTION TWO:

LOT NUMBER ONE (1) OF PERKINS SUBDIVISION, SECTION TWO (2), Beginning at an iron pin at the intersection of two 30-foot streets, at the edge of Section 1, and running thence with the eastern line of one 30-foot street, N. 1° 00' 36” E. 178.18 feet to an iron pin, corner to Lot No. 2; thence with the division line of Lots Nos. 1 and 2, N. 84° 15' 27” E. 109.63 feet to an iron pin; thence S. 11° 12' 49” E. 65.85 feet to an iron pin in line of another 30 foot street; and thence with the northern line of said 30 foot street, S. 45° 06' 53” W. 176.46 feet to the place of beginning, together with the right to use all streets and outlets in said Subdivision and the right to use a certain right of way over and across the lands of David L. Straight and Jacqueline M. Straight, running from Perkins Subdivision to West Virginia State Route No. 17.

This conveyance is made together with all buildings and improvements, rights, roads, ways, easements, privileges, appurtenances, and advantages thereunto belonging or in any way appertaining.

The real estate is subject to all exceptions, reservations, easements, covenants, conditions, agreements, land use regulations, all legal highways, zoning, building ordinances, leases, rights of tenants, rights-of-way, restrictions, servitudes, municipal ordinances, prior out conveyances, prior conveyances of minerals and rights to extract the same, mineral severances and limitations of use as have been imposed upon such property, and those shown on all recorded plats of survey, of record affecting the real estate, to the extent the same are now in effect.

Lot Number One being the same lot or parcel of real estate conveyed to Justin N. Underwood, by the Secretary of Veterans Affairs, an Officer of the United States of America, by that Special Warranty Deed dated January 9, 2018, and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 1222, at page 626.

Lot Number One further being the same lot or parcel of real estate conveyed to Justin Underwood and Danielle Underwood, by Justin N. Underwood, also known as Justin Underwood, by that Quitclaim Deed dated November 25, 2020, and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 1275, at page 211.

Lot Number Two being the same lot or parcel of real estate conveyed to Justin Underwood, by B. W. Yost, by that Special Warranty Deed dated May 16, 2018, and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 1229, at page 23.

And being the same parcels of real estate conveyed unto John Martin Dolog, by deed dated the 29th day of July, 2022, by Justin Underwood and Danielle Underwood, recorded in the aforesaid Clerk's Office in Deed Book 1305, at page 376.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.

The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.

The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of the sale.
