PUBLIC HEARING NOTICE

In accordance with Chapter 8A, Article 5, Section 8 of the Code of West Virginia 2004, as amended, the Berkeley County Planning Commission will hold a public hearing to consider the public comments on the following projects:

REQUEST FOR DETAILED SITE PLAN APPROVAL: Superior Construction & Hauling: The site is located on the southeast corner of the southern cul-de-sac on Sue Court, east of Winchester Avenue (US Rt. 11), in the Arden Tax District. The developer is proposing a 6,000 sq. ft. maintenance building and paved parking area for equipment on 2.17 acres, to be served by public water and sewer. File# 2508-241

REQUEST FOR DETAILED SITE PLAN APPROVAL: 184 True Apple Way: The site is located at 184 True Apple Way, in the Mill Creek Tax District. The project proposes four (4) residential lots, on 0.5 acres. To be served by public water and sewer. File# 2601-025 tied to 2508-233, 2512-352

REQUEST FOR MAJOR PLAN CHANGE APPROVAL: Nadenbousch Pines, Phase 4 – Lots 101 123: The project is located on Nadenbousch Lane (WV Rt. 34), approximately one (1) mile east of its intersection with Winchester Avenue (US Rt. 11), in the Arden Tax District. The Major Plan Change proposes 23 single-family lots, on approximately 34 acres, to be served by public water and sewer. File# 2505-162

REQUEST FOR WAIVER: John Dellinger: The site is located at 587 Abe Myers Road, approximately half a mile from Back Creek Valley Road (WV Rt. 7), in the Hedgesville Tax District. The developer is requesting a waiver to Section 505.d, of the Subdivision and Land Use Ordinance (2025), requiring a 50′ right-of-way/easement from the proposed administrative subdivision lot(s) to a WVDOH right-of way. The PUBLIC HEARING will be held on Monday, May 18, 2026, in the County Commission Chambers, 400 West Stephen Street, in the City of Martinsburg at 6:00 p.m. All persons and agencies having an interest on said plats are invited to participate in this hearing and make their comments known.

In the event that an unforeseen circumstance would cause the Planning Commission to cancel the scheduled meeting, a back-up public hearing date Monday, June 1, 2026 will be utilized.
