TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 20, 2017, and duly recorded in the Office of the Clerk of the County Commission of Taylor County, West Virginia, in Document No. 2017008042, in Book No. 355, at Page 1, Shawn K Harvey and Vaughn Harvey did convey unto Michael L. Solomon, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Taylor County Courthouse Annex in Grafton, West Virginia, on May 20, 2026 at 1:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Booths Creek District, Taylor County, West Virginia, and more particularly described as follows: All of those certain lots or parcels of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate along the Woodsdale Cemetery Road leading to U.S. Route No. 50, situate in Booths Creek District, Taylor County, West Virginia, and being more particularly bounded and described as follows: PARCEL ONE: BEGINNING at a 1/2″ iron pin set in the westerly line of Woodsdale Cemetery Road, a common corner to Lot No. 3; thence running with three lines of said road, S 48-32-00 E 66.77 feet to a 1/2″ iron pin found, thence 43-35-00 E 88.12 feet to a 1/2″ iron pin found, thence S 39-26-00 E 45.11 feet to a 1/2″ iron pin set, corner to Lot No. 5; thence leaving said road and running with a line of said lot, S 41-06-37 W 239.77 feet to a 1/2″ iron pin set, another corner to said lot in line of a tract owned by Cecelia A. and Harry R. Hood; thence with a line of said tract, N 44-50-00 W 190.00 feet to a 1/2″ iron pin set corner to Lot No. 3; thence running with a line of same, N 38-52-08 E 242.49 feet to the place of beginning, containing 1.088 acres. Gowans, husband and wife, by deed dated the 8th day of November, 2007, of record in the Office of the Clerk of the County Commission of Taylor County, West Virginia, in Deed Book 304, at page 387, to which deed and aforesaid plat reference is here made for all pertinent purposes. PARCEL TWO: BEGINNING at a 1/2″ iron pin set in the westerly line of Woodsdale Cemetery Road, a common corner to Lot No. 4; thence running with a line of said road, S. 39-26-00 E. 100.00 feet to a 1/2″ iron pin set, corner to Lot No. 6; thence leaving said road and running with a line of said lot S. 44-34-01 W. 229.77 feet to a 1/2″ iron pin set; another corner to said lot in line of a tract owned by Cecelia K. and Harry R. Hood; thence with a line of said tract, N. 44-50-00 W. 85.00 feet to a 1/2″ iron pin set, corner to Lot No. 4; thence with a line of same, N. 41-06-37 E. 239.77 feet to the place of beginning, containing 0.496 acres, and being identified as Lot No. 5, as shown on a plat of survey prepared by Landmark Surveying Company, Fairmont West Virginia, of record in the Office of the Clerk of the County Commission of Taylor County, West Virginia in Deed Book No. 304, at Page 389. PARCEL THREE: BEGINNING at a 1/2″ iron pin set in the westerly line of Woodsdale Cemetery Road, a common corner to Lot No. 5; thence running with two lines of said road, S. 39-26-00 E. 16.98 feet to a 1/2″ iron pin found, thence S. 47-37-00 B sic 83.02 feet to a 1/2″ iron pin set, corner to other lands of Harold W. and Debra I. Gowans; thence leaving said road and running with a line of said lands, S. 48-13-45 W. 232.32 feet to a 1/2″ iron pin set, another corner to said lands in line of a tract owned by Cecelia A. and Harry R. Hood; thence with a line of said tract, N. 44-50-00 W. 85.00 feet to a 1/2″ iron pin set, corner to Lot No. 5; thence running with a line of same, N. 44-34-01 B sic 229.77 feet to the place of beginning, containing 0.488 acres and being identified as Lot No. 6, as shown on a plat of survey prepared by Landmark Surveying Company, Fairmont, West Virginia, of record in the Office of the Clerk of the County Commission of Taylor County, West Virginia in Deed Book No. 304, at Page 389. And further Parcel 2 and Parcel 3 being the same real estate conveyed to Paul G. McKinney and Sharon Kay McKinney, husband and wife, from Harold W. Gowans and Debra I. Gowans, husband and wife, by deed dated the 8th day of September, 2011, of record in the Office of the Clerk of the County Commission of Taylor County, West Virginia, in Deed Book 322, at page 281, to which deed and aforesaid plat reference is here made for all pertinent purposes. And further being the same real estate conveyed to Shawn K. Harvey and Vaughn Harvey by deed to be recorded simultaneously with the recording of this Deed of Trust. This conveyance is made subject to all exceptions, reservations, restrictions, conditions, easements and rights of way as contained in prior deeds of record for this chain of title. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 299 Woodsdale Cemetery Rd, Grafton, WV 26354. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
