Activity:
To acquire, construct, install, operate and maintain a new collection and disposal system and best management practices to collect storm water from a new rail spur and convey it to the existing wastewater treatment plant with ultimate discharge through Outlet 001 into the Ohio River in the vicinity of Mile Point 47.4. Additionally, to acquire, construct, install, operate and maintain a collection and disposal system and best management practices for the direct discharge of treated, non-contact storm water from the new rail spur through new Outlet 005 into an unnamed tributary of Congo Run, a tributary of the Ohio River. Also, to discharge an additional 0.028 mgd of non-contact cooling water, storm water, other miscellaneous wastewaters to existing Outlet 001 from a new electrical cogeneration unit. Tier 2 and Tier I protection are provided for the uses specified in 47 CSR 2, Section 6.

Refining of Appalachian crude oil to manufacture lube oils, gasoline and distillate fuels.

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.

Any interested person may submit written comments on the draft permit modification and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins April 30, 2026 and ends May 30, 2026.

Comments received within this period will be considered prior to acting on the permit modification application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit Modification(s). Interested persons may contact the public information office to obtain further information.

The application, draft permit modification and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV, between 8:00 a.m. and 4:00 p.m. on business days.
