NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated May 9, 2023, executed by Borrower(s), Mark Alan Hamrick, II, to Seneca Trustees Inc., the Trustee of record in the office of the Clerk of the County Commission of Marion County, West Virginia, in Book 1322, at Page 436. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 39 Maidstone Dr, Fairmont, WV 26554. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 4, 2025, of record in the Clerk's Office in Book 1376, Page 149-154. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:

All that certain parcel or lot of real estate, together with the improvements thereon, and appurtenances thereunto belonging, situate and lying along Stoney Lonesome Road, near the Town of Monongah, Lincoln District, Marion County, West Virginia, as more particularly bounded and described as follows:
Beginning at an iron pin and cap found in the western line of the Frazier tract, Parcel 91 on Lincoln District Tax Map 06-38; thence running with the line of said tract, S. 04° 55' 00" E. 112.62 feet to a mag nail found in asphalt driveway, being the northern corner of the Zirkle tract and the Falbo tract; thence with the northern line of said Zirkle tract, S. 53° 06' 13" W. 90.22 feet to a 1" iron pin found, being the southeastern corner of the Mayo tract, Tax Parcel 38 on Lincoln District Tax Map 06-38A; thence N. 24° 17' 01" W. 122.55 feet to an iron pin & cap found, being the southwestern corner of the Dixon tract, Parcel 41.2 on Lincoln District Tax Map 06-38A; thence with the southern line of said tract, N. 64° 09' 46" E. 125.44 feet to the point of beginning, being all of Parcel 40 and 41.1, as shown on Marion County, Lincoln District Tax Map 06-38A, and containing 0.275 acres, more or less. A map or plat of said parcel prepared by Wolfe and Associates Inc., dated October 19, 2007, is recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1029, at Page 388, to which plat reference is hereby made for all pertinent purposes.
This conveyance is made together with all buildings and improvements, rights, roads, ways, rights- of-ways, easements, privileges, appurtenances, and advantages thereunto belonging or in any way appertaining.
The real estate is subject to all exceptions, reservations, easements, covenants, conditions, agreements, land use regulations, rights-of-ways, leases, restrictions, servitudes, municipal ordinances, prior out conveyances, prior conveyances of minerals and rights to extract the same, mineral severances and limitations of use as have been imposed upon such property, and those shown on all recorded plats of survey, of record affecting the real estate, to the extent the same are now in effect.
Being the same lot or parcel of real estate conveyed to M2 Enterprises, LLC, a West Virginia Limited Liability Company, by Richard W. Leeson and Laurie A. Leeson, by that General Warranty Deed dated August 10, 2022, and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 1306, at Page 68.
Further being the same lot or parcel of real estate conveyed to Mark Alan Hamrick, II, by M2 Enterprises, LLC, a West Virginia Limited Liability Company recorded 5/10/2023 in Book 1323, Page 77.
TERMS OF SALE:
1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.
2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
