NOTICE OF TRUSTEE'S SALE

Notice is hereby given that by virtue of the authority under that certain deed of trust executed by John M. Morrison, to Michael L. Solomon, Trustee dated July 19, 2011, and recorded in the office of the Clerk of the County Commission of Marion County, West Virginia, in Trust Deed Book 1007, at page 913, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated February 5, 2025, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on June 11, 2026 at 4:35 p.m., at the front door of the courthouse of Marion County, West Virginia, the real estate conveyed by said deed of trust and situate in Union District, Marion County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 628 E. Park Avenue, Fairmont, WV 26554 and being more particularly bounded and described therein as follows:

LAll of that certain lot or parcel of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate in the East Park Addition to the City of Fairmont, Union District, Marion County, West Virginia, a map or plat of which is of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 178, at pages 446 and 447, described as follows:

LOT NUMBER ONE (1) IN BLOCK NUMBER SIXTEEN (16), fronting 40 feet on East Park Avenue and extending back between parallel lines 100 feet, further described as follows:

BEGINNING at a spike, corner of East Park Avenue and Euclid Street, and running thence with East Park Avenue, N. 66 degrees 24' W. 40 feet to a point in line of East Park Avenue; thence with line of property now or formerly owned by Michael K. McDonald and Joyce A. McDonald, N. 23 degrees 36' E. 100 feet to a point in an alley; thence running with said alley,

S. 66 degrees 24' E. 40.00 feet to a spike in Euclid Street; thence with line of Euclid Street, S. 23 degrees 36' W. 100.00 feet to the place of beginning. A plat of said property is recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 830, at page 1067.

And being the same real estate conveyed to Donna M. Field, now known as Donna M. Willis, and Lewis E. Willis, from Richard L. Smiers and Sharon S. Smiers, husband and wife, by deed dated the 4th day of January, 2002, which said deed is recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 973, at page 461, to which deed and aforesaid plat reference is here made for all pertinent purposes.

And further being the same real estate conveyed to John M. Morrison by deed dated the 8th day of July, 2011 from Donna M. Field, now known as Donna M. Willis, and Lewis E. Willis, recorded in the aforesaid Clerk's Office in Deed Book 1093, at page 55.

This conveyance is made subject to all exceptions, reservations, restrictions, conditions, easements and rights of way as contained in prior deeds of record for this chain of title.

This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.

The property will be conveyed in an "AS IS" condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.

The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

TERMS OF SALE: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of the sale.
