NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated February 28, 2022, executed by the Borrower(s), Curtis Bowie, Sr. and Dawn V. Dorsey, to Sansalone & Sansalone, Attorneys, Law Firm, the Trustee, of record in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Book 3868, at Page 380. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 64 Phoebe Way, Inwood, WV 25428. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated March 16, 2026, of record in the Clerk’s Office in Book 4377, at Page 181. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Berkeley County Clerk’s Office, at 400 West Stephen Street, in Martinsburg, West Virginia, on the following date:
May 19, 2026, 10:04 a.m.
All of that certain real property, with improvements and appurtenances thereunto belonging, situate, and being in Mill Creek District, Berkeley County, West Virginia, and more particularly described as follows:
Lot No. One Hundred Eight (108) on Supplemental Plat “Shickle Lots” made by T. J. Snyder dated August 16, 1964, and recorded in the Office of the Clerk of the County Council of Berkeley County, West Virginia, in Deed Book No. 225, at Page 510, upon which said plat said Lot No. One Hundred Eight (108) is shown as fronting 128 feet on the westerly side of a 50-foot street and extending back of equal width in a westerly direction 334 feet.
TOGETHER WITH AND SUBJECT TO any and all recorded easements and rights-of-way appurtenant thereto for ingress, egress, and utilities, including but not limited to, those set forth on the aforementioned plat.

SUBJECT TO and TOGETHER WITH the following: all covenants, restrictions, conditions, easements, reservations, rights-of-way, public utility easements, and other matters of record or in existence, to the extent valid, subsisting, and enforceable; any lien of taxes for the current year and subsequent years, accrued but not yet payable; matters that would be shown by an accurate survey and inspection of the property; zoning requirements, statutes, rules, orders, restrictions, regulations, and ordinances of governmental agencies or their instrumentalities relating to the property, the buildings located thereon, their construction and uses, in force on the date hereof (if any such exist); and, all roads and legal highways.
AND BEING the same real estate conveyed unto Curtis Bowie, Sr. and Dawn V. Dorsey by Deed dated the 28th day of February, 2022, from Sylvia Durant, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 1382, at Page 267.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) Pursuant to the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements.
7) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
