ORDER OF PUBLICATION
The reason for this cause is to obtain the whereabouts of any persons including but not limited to: Curtis Gum, James Catalogna, and any other persons having an interest in the surplus proceeds of a trustee’s sale pursuant to a Deed of Trust dated December 23, 1996 executed by Cecil E. Gum and Debra K. Gum for the benefit of Green Tree Consumer Discount Co. and secured by the property commonly known as 238 Crossroads Road, Wana, West Virginia 26590, f/k/a Route 67 Box 1517, Wana, West Virginia 26590. This Deed of Trust was recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia in Trust Deed Book 836, at Page 120.
And it appearing by that the identity and whereabouts of Defendants, Curtis Gum, James Catalogna, and any other persons having an interest in the surplus proceeds, are unknown, and/or cannot be located after due diligence, it is ORDERED that the above named Defendants serve upon Plaintiff’s attorney Lakyn D. Cecil, of the law firm of Samuel I. White, P.C., whose mailing address is 5000 Coombs Farm Drive, Suite 104, Morgantown, WV 26508, an Answer or any defense to the Complaint for Interpleader filed in this action, on or before June 21, 2026; otherwise judgment by default may be taken against said Defendants at any time thereafter. A copy of the Complaint in this action may be obtained from the undersigned Clerk’s office.
Upon consideration whereof, this Order of Publication is granted, and is ORDERED that any interested persons do appear here on or before June 21, 2026, which date is no sooner than thirty (30) days after entry of this Order of Publication.
And it is further ORDERED that this Order of Publication be published once a week for two (2) successive weeks in the Dominion Post newspaper, a newspaper of general circulation in the County of Monongalia, West Virginia.
