LEGAL NOTICE –
REQUEST FOR PROPOSALS FOR BOND COUNSEL

The Town of Athens, Mercer County, West Virginia is in the process of procuring bond counsel services
necessary to complete the Athens Water System Improvements and Extensions Project(s). The selected
professional will work closely with all members of the project team, including the Town of Athens and Region I Planning & Development Council. The selected bond counsel is an integrate part of the project team and will work closely with the project team to complete all necessary services in relation to the project.

Procurement of the said services shall be in accordance with 2 CFR 200.320 (b)(2). Contracts are to be awarded on familiarity with and expertise on this type of project, as well as on a fixed basis for services. All those interested in being considered for this must submit a proposal detailing qualifications and staffing capabilities, related prior work experience, fee schedule, and ability to complete work as needed on this project in a timely manner.

Contracts will be awarded to the responsible offeror whose proposal is within the competitive range and determined to be the most advantageous to the project; price and other factors considered including familiarity and expertise with this type of project. The consultant's eligibility to receive federal funds will be verified at http://www.sam.gov prior to contract award.

Attention is directed to the fact that the project may be undertaken with, but not limited to, West Virginia Bureau for Public Health's (BPH) Drinking Water Treatment Revolving Fund (DWTRF), West Virginia Department of Environmental Protection (WVDEP), West Virginia Infrastructure and Jobs Development Council (IJDC), Appalachian Regional Commission (ARC) funding, U.S. Department of Housing and Urban Development's Community Development Block Grant (HUD CDBG), and United States Department of Agriculture's Rural Development (USDA-RD) funding.

All work will be performed in accordance with the regulations issued by WV BPH DWTRF, WVDEP, WVIJDC, ARC, HUD/CDBG, USDA-RD, and the State of West Virginia appertaining thereto. The selected firm(s) will be required to comply with Executive Order 11246, Section 3 of the Housing and Urban Development Act of 1974, Conflict of Interest Statement and Access of Records, Title VI, and Section 109.

The Town of Athens will afford full opportunity for minority business enterprises to submit a show of interest in response to this invitation and will not discriminate against any interested firm or individual on the grounds of race, color, creed, sex, age, handicap or national origin in the contract award.

The Town of Athens reserves the right to accept or reject any and/or all proposals. The Town of Athens also reserves the right to negotiate the fee for services.
