TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vesting in it by that certain Deed of Trust, recorded on July 19, 2024, in the Office of the Clerk of the County Commission of Lewis County, West Virginia, in Book 473 at Page 436, Nathanielle L. Butler did convey unto Terry D. Reed, as Original Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Elk River Trustees Inc., as Substitute Trustee by virtue of a Substitution of Trustee recorded on March 10, 2026, in Book 482 at Page 881 in the aforesaid Clerk’s Office; the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said Deed of Trust to sell the real estate described below, as there has been a default under the terms and conditions of said Deed of Trust. Therefore, the undersigned Substitute Trustee having been instructed by NewRez LLC to foreclose thereunder will offer for sale, at a public auction at the front door of the Lewis County Courthouse in Weston, West Virginia, on June 10, 2026 at 11:00 AM the following described real estate, together with its easements, improvements, and appurtenances thereunto belonging, situate in the City of Weston, Lewis County, West Virginia, and more particularly bounded and described as follows: LEGAL DESCRIPTION All those three (3) certain tracts, lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, including any manufactured structures, mobile homes, double wide or modular homes, situate in what is known as T. W. Hale’s Subdivision “Central View”, just North of the Baltimore and Ohio Railroad Passenger Station, in the City of Weston, Freeman’s Creek District, Lewis County, West Virginia, that is to say: FIRST TRACT: Lot No. 2 in said subdivision, fronting on Hale Street and Central Drive as designated on a plat of said subdivision made by W. K. Spaur, Engineer, said plat being marked, “Revised Map, August 25, 1925”, and of record in the Office of the Clerk of the County Commission of Lewis County, West Virginia, in Plat Book No. 1, at page 130. Together with the right in said party of the second part, their heirs and assigns, to connect with and maintain a sewer line for the use of the property herein conveyed with the sewer heretofore· constructed by T. W. Hale, and wife, from a point near the Morrison property through to the West Fork River. This conveyance is made subject to the following stipulation contained in a former deed in the Grantor’s chain of title from T. W. Hale and Minnie N. Hale, his wife, to the said W. M. Pickering bearing date the 3rd day of September, 1925, and of record in said Clerk’s office in Deed Book No. 119, at page 374, that is to say: “It is further understood and agreed that no dwelling house shall be erected on said Lot No. 2 at a cost of less than $1,500.00.” SECOND TRACT: Lot No. 1 as shown on the plat of T. W. Hale’s Subdivision, “Central View”, of record in the Office of the Clerk of the County Commission of the said County of Lewis in Plat Book No. 1, at page 130, and which said lot is triangular in shape and lies at the intersection of the southeast side of Central Drive, of said Subdivision, and the southwest side of the 15-foot section of Thomas Street, of said Subdivision, and is bounded as follows: Beginning at stake in said southeast side of said Central Drive, comer to Lot No. 2, of said Subdivision, and running thence with said southeast side of said Central Drive, N. 12 28 E. 125 feet to stake at terminus of southwest side of said Thomas Street; thence with said southwest side of said Thomas Street in a southeasterly direction for 75 feet to stake, and thence S. 48 55 W. 95 feet to the place of beginning. THIRD TRACT: The following lot or parcel of real estate, situate in what is known as T. W. Hale Subdivision “Central View”, just North of the Baltimore & Ohio Railroad Station in the City of Weston, County of Lewis, State of West Virginia, and being Lot No. 3 in said Subdivision fronting on Hale Avenue as designated on a plat of said Subdivision made by W. K. Spaur, Engineer, and of record in Plat Book No. 1, at page 130, in the Office of the Clerk of the County Commission of Lewis County, West Virginia, and which plat is marked “Revised Map, August 25, 1925”. The property herein conveyed are the same tracts conveyed to Erico Cardelli, Anna K. Cardelli and Solaris B. Cardelli by Enzo Cardelli and Roberta Cardelli, by deed dated November 12, 2021, and of record in the Office of the Clerk of the County Commission of Lewis County, West Virginia in Deed Book 778 at page 8. Subsequently by deed dated June 27, 2024 and to be recorded in said Clerk’s Office prior to or simultaneously with this trust deed, Erico Cardelli, Anna K. Cardelli and Solaris B. Cardelli conveyed the subject property to Nathanielle L. Butler. There is excepted and reserved from the aforesaid property all of the coal, oil and gas in, upon and underlying the same together with the necessary mining and removal rights, as the same have heretofore been excepted and reserved or conveyed away by the present or former owners. This conveyance is made subject to all existing reservations, restrictions; exceptions, conditions, easements, rights of way or other servitudes, if any, made, reserved or created in prior deeds of record in said Clerk’s office, or which would be disclosed by a visual inspection of the premises. For the stated consideration, the Grantor does further grant and convey unto the Trustee all rights of way and easements, together with all appurtenances pertaining to the aforesaid real estate, whether presently owned or hereinafter acquired, which are matters of record in said Clerk’s office or otherwise. In the event the property described herein is subject to any other trust deeds securing the secured party herein, at the election of the secured party, default under any of said trust deeds shall constitute default under all trust deeds. The property was reported to have an address of: 10 Nutter Court, Weston, West Virginia 26452 The above referenced real estate will be conveyed with no covenants of warranty and subject to any and all easements, rights of way, conditions, covenants, restrictions, exceptions, reservations, leases and other servitudes, which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. The sale of the referenced real estate will also be subject to all prior liens and including any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the subject Deed of Trust. The subject property will be sold in an “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. In the event that there are federal tax liens against the property, the United States has the right to redeem the property within a period of one hundred twenty (120) days from the date of the sale. The Substitute Trustee reserves the right to adjourn the sale for a time, or from time to time, without further notice, by announcement at the time and place of the foreclosure sale described herein. TERMS OF SALE 1. $8,000.00 (Eight Thousand Dollars) in cash and/or certified funds made payable to “Elk River Trustees, Inc.” due as a deposit at the time of sale, with the balance due and payable within thirty (30) days of sale. Personal checks will not be accepted. 2. The purchaser at the sale shall be responsible for payment of all real estate taxes. 3. The purchaser shall be responsible for payment of the recording cost of the deed and also for payment of the tax on the privilege of transferring the real property (transfer tax) imposed by West Virginia Code 11-22-2. 4. The parties secured by the Deed of Trust reserve the right to purchase the property at the foreclosure sale. 5. The purchaser, if applicable, shall be responsible to provide all necessary information, including but not limited to entity full legal name and DBA, dates of birth and EIN/tax identification numbers, entity owner information, trust information including date of execution, trust beneficial owner information, etc., to the Substitute Trustee to ensure compliance with any necessary United States Financial Crimes Enforcement Network (FinCEN) reporting requirements.
