The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 10, 2005, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1282, at Page 546, Christopher J. Mooss and Suzanne M. Flick-Mooss did convey unto McCamic, Sacco, Pizzuti & McCoid, PLLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse, in Wheeling, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Richland Country District, Ohio County, West Virginia, and more particularly described as follows:
FIRST PARCEL: That certain parcel of land situated on the easterly side of the Greggsville, Clinton Potomac Public Road (formerly known as Old Bethany Pike), in Richland District, Ohio County, West Virginia, and comprising all of Lot Numbered Thirty-Five (35) and the southerly one-half of Lot Numbered Thirty-Six (36), as shown on the “Map of Washington Acres”, said map being recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 309, at Page 122, and being more particularly bounded and described as follows:
Beginning at a point in the center line of the present paving of the Greggsville, Clinton & Potomac Public Road at its intersection with the division line between Lots Numbered Thirty-Four (34) and Thirty-Five (35) as shown on said map; thence from said beginning point, and with the same center line, N. 38 deg. 52′ E. (at 60 feet passing the division line between Lots 35 and 36) 90 feet to a point; thence leaving said center line and crossing through said Lot Numbered Thirty-Six (36), S. 51 deg. 08′ E. (passing 30 feet measured S. 38 deg. 52′ W. 30 feet from a concrete monument; thence with the rear or easterly line of said Lots Numbered Thirty-Six (36) and Thirty-Five (35), S. 38 deg. 52′ W. 90 feet to a point in the said division line between Lots Numbered Thirty-Five (35) and Thirty-Four (34); thence with the same N. 51 deg. 08′ W. 420 feet to the place of beginning, as the same was surveyed by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, June, 1958.
SECOND PARCEL: That certain parcel of land situated on the easterly side of the Greggsville, Clinton and Potomac Public Road (formerly known as Old Bethany Pike), in Richland District, Ohio County, West Virginia and comprising of the northerly twenty (20) feet of Lot Numbered Thirty-Four (34), as shown on the “Map of Washington Acres”; said map being recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 309, at Page 122, to which reference is hereby made for a more particular description of the lot hereby conveyed.
This conveyance of both parcels, is made subject to exceptions, reservations, restrictions, covenants, conditions, easements and rights of way referred to or contained in this Deed, any aforementioned Deeds and/or Plats, and all prior conveyances of record.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 228 G C & P Road, Wheeling, WV 26003.
AND BEING the same real estate which was conveyed to Christopher J. Mooss and Suzanne M. Flick-Mooss, by Deed dated November 8, 2005, from John E. Hepburn and Caroline J. Hepburn, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 764 at Page 331.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
