Application for a certificate of need to incorporate
a solidification process.
NOTICE OF FILING
On March 19, 2026, Valero Terrestrial Corporation
dba Brooke County Sanitary Landfill (Brooke), filed
an application, duly verified, to modify its existing
Certificate of Need for the Brooke County Landfill to
incorporate a solidification and stabilization process
in an existing building at the landfill facility, which
process has been occurring at the facility pursuant to a
West Virginia Department of Environmental Protection
Permit Modification issued in 2014. The Certificate of Need Modification Application is on file and available for
public inspection at the Public Service Commission, 201 Brooks Street in Charleston, West
Virginia.
The proposed Certificate of Need Modification
Application to Incorporate a Solidification and
Stabilization Process will not impact the rates under
Brooke’s current Commission-approved
Tariff for the Brooke County Landfill, and there is
no need to change the rates under the approved Tariff
because of the proposed Certificate of Need
Modification Application.
Anyone desiring to protest or intervene should file a
written protest or request to intervene within thirty
days following the date of this publication. Failure
to timely protest or request to intervene
can affect your right to protest aspects of this case or to
participate in the proceedings. All protests or requests to
intervene should briefly state the reason for the protest
or request to intervene. Requests to intervene must
comply with the rules on intervention set forth in the
Commission Rules of Practice and Procedure. All
protests and requests to intervene should be
addressed to Commission Executive Secretary, P. O. Box 812, Charleston, West Virginia 25323. Comments may also be filed at
the Commission website.
If no protests are received within the stated thirty-day period, the Commission may waive formal hearing and grant the application based on the Commission review of the evidence submitted with the application.
