application, duly verified, to modify its existing
Certificate of Need for the Brooke County Landfill to
incorporate a solidification and stabilization process in
an existing building at the landfill facility, which process
has been occurring at the facility pursuant to a West

the rates under the approved Tariff because of the
proposed Certificate of Need Modification Application.
