NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEES SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated December 29, 2023, executed by the Borrower, Cody Allen King, to Sansalone & Sansalone, Attorneys, Law Firm, the Trustee, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 2590, at Page 559. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1627 Grafton Road, Morgantown, WV 26508. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated March 30, 2026, of record in the Clerks Office in Book 2693, at Page 409. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on the following date:
June 11, 2026, at 5:34 p.m.
All of the following described parcel of real estate together with the
improvements thereon and the appurtenances thereunto belonging,
situate, lying and being in Clinton District, Monongalia County,
West Virginia, and more particularly described as follows:
Beginning at a point standing on the eastern right of way limits of
U.S. Route 119, corner to other properties of Richard C. Brown;
thence with three (3) arbitrary lines of Richard C. Brown, S. 65° 51`
16″ E. (passing through a l/2 inch iron pin set at 18.54 feet) 156.54
feet to a 1/2 inch iron pin; thence S. 2° 06` 56″ E. 47.87 feet to a
1/2 inch iron pin; thence S. 32° 39` 27″ W. 124.41 feet to a 1/2
inch iron pin in the line of John McDaniel; thence running with
the McDaniel line N. 48° 49` 10″ W. (passing through a 1/2 inch
iron pin found on line at 95.55 feet) 105.65 feet to a point standing
on the eastern right of way limits of U.S. Route 119; thence with
a curve to the left along the eastern right of way limits of U.S
Route 119 having a radius of 853.51 feet and a length of 147.25 feet
to the place of beginning, containing 0.4659 acres, more or less,
as shown on a plat prepared by McCoy Surveying Company, Inc,
dated June, 1990 of record in the Office of the Clerk of the
County Commission of Monongalia County, West Virginia, in
Deed Book 1013, at page 332.
Together with and subject to a fourteen (14`) in width right of way
over an existing driveway for purposes in ingress, egress and
regress to and from U.S. Route 119, as more particularly set forth
in the Deed dated June 14, 1990, of record in said Clerks Office
in Deed Book 1013, at Page 330, and as shown upon the above
referenced plat of survey.
Being the same real estate conveyed by Deed dated June 6, 2005,
of record in said Clerk`s Office in Deed Book 1296, at page 454,
from Mary L. Austin to Greg Ice.
AND BEING the same real estate conveyed unto Cody Allen King by Deed dated the 4th day of December, 2023, from Greg Ice, and recorded in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Deed Book 1835, at Page 498.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition
by Deed containing no warranty, express or implied, subject to
the Internal Revenue Service right of redemption, all property taxes,
prior Deeds, liens, reservations, encumbrances, restrictions,
rights-of-ways, easements, covenants, conveyances and conditions
of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer
taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note
reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject
property from time to time by written or oral proclamation, which
continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant
or person occupying the property to vacate said property, and any
personal property and/or belongings remaining at the property
after the foreclosure sale will be deemed to constitute ABANDONED
PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30)
days of the date of sale, with ten (10%) of the total purchase price
payable to the Trustee at sale.
