NOTICE OF SALE
Pursuant to an Order of the Family Court of Tyler
County, West Virginia, Philip J. Bowser, Special
Commissioner, will on July 8, 2026 at 10:00 A.M. at the
front door of the Tyler County Courthouse at 121 Main
Street, Middlebourne, Tyler County, West Virginia, offer
to the highest bidder the following real estate situate in
McElroy District, Tyler County, West Virginia, further
described as follows:
Situate on the left fork of Indian Creek, McElroy
District, Tyler County, West Virginia, and more
particularly described as follows:
BEGINNING at a point near the center of the left branch
of the left fork of Indian Creek Road at the intersection
of a private driveway leading to the G. C. Wadsworth
home on a 100 acre tract and a corner with the Lucille
Stackpole 25 acres as a part of a former Mary A.
Thompson 90 acres as found in Deed Book No. 15 at
Page 371-1890, then with the same down the road S 36
50′ E 283 feet to a point at the forks of the road and
being a corner to the Hattie McCoy 25 acres as part of
the Thompson land and with the same up the right
branch of the left fork of Indian Creek, N 47 10′ E for
153 feet to a point in the road center, then with the same
N 37 25′ E for 311 feet to a point in the road center,
then by a carving line N 52 35 W and at 40.6 feet a pipe
set in line at the top of the road bank and on the same
course for 59.5 feet to a pipe set in the lower side of an
oil or farm road, a total of 100.1 feet then along this farm
or oil road up the hill S 53 05 W for 157 feet to a pipe in
the road side then N. 78 14′ W crossing a turn in the
road and at 61 feet a pipe in line on top of the road
bank, and at 123.9 more, a total of 184.9 feet, another
pipe driven, then down hill S 34 33′ W passing over a
pipe on top of the road bank a total of 155 feet to the
beginning, containing 2.18 acres, more or less.
EXCEPTING AND RESERVING from the operation of
this conveyance any property embraced within the
above description which fall on or along that certain
road shown and designated as the Hill Road along the
line designated as S 53 05′ W 157 feet on a plat
recorded in the Office of the Clerk of the County
Commission of Tyler County, West Virginia, in Deed
Book No. 227 at Page 4.
Being the same property that was conveyed unto
Joseph Dudley by Bruce A. Parlette and Sherri E.
Parlette, his wife, by deed dated the 8th day of
November, 2010 and recorded in the Office of the Clerk
of the County Commission of Tyler County, West
Virginia in Deed Book 384, at page 279.
Terms of sale shall be 10% of the sale price on day of
sale and the balance shall be paid within thirty (30) days
of the day of sale.
The property will be offered for sale without warranty.
The Special Commissioner reserves the right to
adjourn the sale from time to time by oral proclamation.
