ORDINANCE PROVIDING FOR THE ADOPTION OF
SEWER RATES FOR THE CITY OF GARY
MUNICIPAL WASTEWATER SYSTEM
Notice is hereby given that the City of Gary will hold a public hearing on Tuesday, June 16, 2026, at 6:00 PM, at the Council Chambers of the City, Gary City Hall, 25 Smoke Eaters Drive, Gary, West Virginia 24836, before the final vote on a proposed ordinance, the principal object of which is the increase of sewer rates for customers of the City of Gary Municipal Wastewater System. The City of Gary is concerned about the availability and reliability of sewer or wastewater collection and treatment facilities for its customers and citizens, including the age of the current treatment facility and the need for maintenance and improvements thereto. The City is applying for funding to secure improvements to, relocation, and expansion of its wastewater treatment and collection system, and the City, in order to fund the expense of those improvements and the ongoing cost of operations of the wastewater treatment system, has deemed it necessary upon the advice of its project team to implement an increase in rates. The proposed rates are as described as follows:
WHEREAS, the sewer rates of the City of Gary must be revised in accordance with the rates, rules, and regulations of the Public Service Commission of West Virginia,
NOW, THEREFORE, BE IT RESOLVED, that the sewer rate schedule set forth herein shall be adopted as follows:
Section 1:Title.This ordinance shall be referred to as, "AN ORDINANCE PROVIDING FOR THE ADOPTION OF SEWER RATES FOR THE CITY OF GARY MUNICIPAL SEWER SYSTEM AND SAID CHANGES TO BE EFFECTIVE FOR ALL BILLS DATED JUNE 1, 2026, AND THEREAFTER UNTIL SUBSEQUENT REVISION."
Section 2:Purpose.This ordinance is to revise the sewer rates of the City of Gary.
Section 3:Applicability.The ordinance applies to all property within the city limits of the City, with
availability for general, domestic, commercial, and industrial services.
Section 4:Rates.(Based on Water Usage) Seven dollars and twenty-seven cents ($7.27) per each 1,000 gallons of water used each month.
Section 5:MinimumTwenty-four dollars and eighty-one cents ($24.81). The minimum charge includes a Charge.three-dollar ($3.00) service charge. No sewer bill will be rendered for less than $24.81. This minimum charge includes a three-dollar ($3.00) service charge.
Section 6:IndustrialIndustrial customers will be billed at a flat rate of $182.00 per Month. This includes
Customers.A three-dollar ($3.00) service charge.
Section 7:DelayedThe above tariff is net. On all accounts not paid in full when due, ten percent Payment(10%) will be added to the net current amount unpaid. This penalty is not interest Penalty.and is only to be collected once for each bill where it is appropriate.
Section 8:Deposit.$50.00 water deposit only required.
Section 9:Separability.If any provision or part thereof is declared invalid, the remainder shall not be
affected thereby.
Section 10:EffectiveThis ordinance shall become effective forty-five (45) days after its adoption and
