Now comes the Court, the Honorable C. Richard Wilson, Chief Judge of the 2nd
Judicial Circuit, and FINDS as follows:
WHEREAS, Candy Warner tendered her resignation due to retirement as Circuit
Clerk for Tyler County, effective May 14, 2026. Pursuant to the provisions of W. Va.
Code §§ 3-10-1, 3-10-6, and 3-5-19, the unexpired portion of her elected term of office
must be filled by special election at the next general election.
ACCORDINGLY, it is hereby ORDERED that the unexpired term for the office of Tyler
County Circuit Clerk will be filled by the voters of Tyler County, West Virginia in a
special election to be placed on the ballot and conducted concurrently with the 2026
General Election to be held on Tuesday, November 3, 2026.
Pursuant to W. Va. Code § 3-5-19, a nominee of each political party may be
appointed by the executive committee and certified to the proper filing officer no later
than 78 days before the general election. Pursuant to W. Va. Code § 3-10-1(f),
citizens having no party affiliation may nominate candidates as provided by W. Va.
Code §§ 3-5-23 and 3-5-24.
In addition, in accordance with W.Va. Code § 3-10-1(e), it is further ORDERED that
the Clerk of the Tyler County Commission shall cause this Order and Proclamation to
be published as a Class 1-0 legal advertisement in the Tyler Star News.
The Circuit Clerk shall provide a copy of this Order to the Tyler County Clerk of the
County Commission.
