NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust executed June 24, 2024, executed by the Borrower, Harry T. Mitchell, an unmarried person, to Toby Lucas, Jr., the Trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1474 at Page 211. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 504 Monterey H1, Bluefield, WV 24701. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 26, 2026, of record in the Clerk's Office in Book 1502, at Page 358. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:
July 7, 2026, at 10:56 a.m.
Situate in the City of Bluefield, Mercer County, West Virginia, being known as Lot 11, Section 943, as shown on map of record in the Mercer County Clerk's Office as Microfilm Plat No. 1769 and which property is more particularly bounded and described as follows:
BEGINNING at a point in the south line of Monterey Hill (formerly Summit Avenue) which point is S. 66° 33' W. 381.26 feet from the point of intersection of the south line of Monterey Hill (formerly Summit Avenue) with the west line of Spring Garden Drive, said point of beginning being also the northwest corner of Lot No. 12, Section 943; thence, along the western side of said Lot No. 12, S. 23° 27' E. 175 feet to a point in the northern line of Lot No. 4, Section 943; thence along the northern line of said Lot No. 4, S. 66° 33' W. 90.64 feet to a point located at the northeastern corner of said Lot No. 4; thence along the eastern sides of Lots Nos. 3 and 10, Section 943, N. 23° 27' W. 175 feet to a point in the south line of Monterey Hill (formerly Summit Avenue) and at the northeast corner of said Lot No. 10; thence along the south line of Monterey Hill (formerly Summit Avenue) N. 66° 33' E. 90.64 feet to the point of BEGINNING." And being the same property conveyed to Matthew Corrigan and Laura Grace-Corrigan by Deed dated October 31, 2022 and recorded November 4, 2022, in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 1120, page 75 from Jeremy R. Crews, Kerri E. Crews and Barbara A. Dale.
And further being the same property conveyed to Harry T. Mitchell by Deed dated June 24, 2024 and recorded June 24, 2024, in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 1138, page 797 from Matthew Corrigan and Laura Grace-Corrigan.
TERMS OF SALE:
1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
