Public Notice

The City of Fairmont's Board of Zoning Appeals will hold a public meeting at 7 pm, July 2, 2026, in the Public Safety Building (500 Quincy Street) at which time interested persons may appear and be heard regarding the following:

BZA 26-03 Aaron Ashley is applying for a Variance to exceed the 4' maximum permitted height of frontyard fencing to install a 5' fence at 314 1st Street. The property is zoned City Center and can be identified as District 3, Map 2, Parcel 181.

BZA 26-06 Linda Bond of 1116 Fairfax St is appealing a decision made to deny a variance request at 1116 Fairfax St on the determination that the variance petition did not meet the minimum requirements for a variance, which includes: not adversely affecting the public health, safety, or welfare or rights of adjacent property owners, residents of the neighborhood; arises from special conditions or attributes which pertain to the property for which a variance is sought and which were not created by the person seeking the variance; would eliminate an unnecessary hardship and permit a reasonable use of the land; and is the minimum variance that will accomplish this purpose. The variance was to construct a solid six-foot-tall wooden fence on a public right-of-way that is a partially opened alley along the rear lot line of 1116 Fairfax St.
