In execution of the Deed of Trust in the original principal amount of $67,250.00, dated March 26, 2012, and recorded in Deed Book 1110, Page 794 and as Instrument Number 120001042 in Tazewell County land records, the appointed Substitute Trustee will offer for sale at public auction at Main Entrance of the Circuit Court for Tazewell County, located at 135 Court Street, Tazewell, VA 24651-1071 on July 24, 2026 at 1:15 PM, the property described in said deed of trust, located at the above address and more particularly described as follows:

ALL THE FOLLOWING DESCRIBED PROPERTIES:
PARCEL 1: ALL THE FOLLOWING DESCRIBED REAL ESTATE, LYING AND BEING SITUATE NEAR CLIFFIELD, TAZEWELL COUNTY, VIRGINIA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:

"BEGINNING AT A RAILROAD TIE FENCE POST AT THE NORFOLK AND WESTERN RAILROAD CROSSING RUNNING WITH THE PRIVATE ROAD, 173 FEET ALONG THE EAST SIDE OF SAID PRIVATE ROAD TO A POST, A CORNER TO THE ROBERT JACKSON LINE, THENCE WITH THE ROGER JACKSON LINE, 150 FEET TO A POST, THEN LEAVING THE ROBERT JACKSON LINE, RUNNING WITH THE CLYDE SMITH LAND, 175 FEET TO A FORK LOCUST TREE IN A LINE OF CLYDE BEAVERS, THENCE WITH THE CLYDE BEAVERS LAND, 275 FEET TO THE NORFOLK AND WESTERN RAILROAD RIGHT OF WAY, THENCE WITH THE NORFOLK AND WESTERN RAILROAD RIGHT OF WAY, 263 FEET WEST TO THE BEGINNING CORNER AT THE SAID NORFOLK AND WESTERN RAILROAD CROSSING CONTAINING ONE AND ONE-QUARTER ACRES MORE OR LESS, BUT BEING SOLD BY THE BOUNDARY AND NOT BY THE ACRE.

"GRANTORS CONVEY UNTO THE GRANTEES THEIR HEIRS AND ASSIGNS AN EASEMENT TO REASONABLE USE OF THE AFOREMENTIONED 12 FOOT PRIVATE ROADWAY BETWEEN THE LAND BEING CONVEYED HEREIN TO THE GRANTEES AND THE CLYDE SMITH LAND, SUE OF THE SAID EASEMENT TO EXTEND BOTH TO THE GRANTEES HEREIN AND THEIR HEIRS, AND ASSIGNS FOR A DISTANCE OF 173 FEET FROM THE BEGINNING CORNER OF SAID PROPERTY ALONG SAID PRIVATE ROAD TO THE ROBERT JACKSON CORNER."

'GRANTORS ALSO CONVEY UNTO THE GRANTEES, THEIR HEIRS AND ASSIGNS, FOREVER, WATER RIGHTS BY USE OF THREE-QUARTER INCH PIPE TO THAT CERTAIN SPRING LOCATED ON THE CLYDE SMITH PROPERTY, TOGETHER WITH THE RIGHT TO GO UPON THE SAID SMITH PROPERTY FOR PURPOSES OF INSTALLING, CLEANING AND MAINTAINING SAID WATER PIPE, AND ALSO FOR THE PURPOSE OF CLEANING AND MAINTAINING THE SPRING."

PARCEL 2: THE FOLLOWING DESCRIBED REAL ESTATE, LYING AND BEING SITUATE IN THE CLIFFIELD AREA, MAIDEN SPRINGS DISTRICT, OF TAZEWELL COUNTY. VIRGINIA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:

"BEGINNING AT A RAILROAD TIE FENCE POST AT THE NORFOLK AND WESTERN RAILROAD CROSSING RUNNING WITH THE PRIVATE ROAD 125 FEET ALONG THE EAST SIDE OF SAID PRIVATE ROAD TO A POST, THENCE IN AN EASTWARDLY DIRECTION THROUGH THE VANHOOZIER LAND, A DISTANCE OF 263 FEET MORE OR LESS TO A POST ON THE CLYDE BEAVERS LAND, THENCE IN A NORTHERLY DIRECTION A DISTANCE OF 100 FEET TO THE NORFOLK AND WESTERN RIGHT OF WAY, THENCE WITH THE NORFOLK AND WESTERN RIGHT OF WAY, 263 FEET IN A WESTERLY DIRECTION TO THE BEGINNING CORNER AT THE SAID NORFOLK AND WESTERN RAILWAY CROSSING, AND BEING A PORTION OF THAT SAME AND IDENTICAL REAL ESTATE WHICH WAS CONVEYED TO THE GRANTORS HEREIN BY THAT CERTAIN DEED DATED THE 22ND DAY OF DECEMBER, 1971, FROM CLYDE SMITH AND BEATRICE SMITH, HIS WIFE, TO JAMES E. VANHOOZIER AND ROSA VANHOOZIER, SAID DEED TO BE RECORDED PRIOR TO THE RECORDATION OF THIS DEED."

AND BEING THE SAME PROPERTY CONVEYED TO THE GRANTOR HEREIN, FROM DEBORAH KAY KEYSER, EXECUTRIX OF THE ESTATE OF HELEN ELIZABETH CHRISTIAN, BY DEED DATED THE 26TH DAY OF MARCH, 2012, RECORDED IN THE CLERK'S OFFICE OF THE CIRCUIT COURT OF TAZEWELL COUNTY, VIRGINIA, SIMULTANEOUSLY HEREWITH.

The property and improvements will be sold in "as is" physical condition without warranty of any kind.

TERMS OF SALE: A non-refundable bidder's deposit of 10% of the sale price or 10% of the original principal amount of the subject Deed of Trust, whichever is lower, by cashier's or certified check required at time of sale except for the party secured by the Deed of Trust. Risk of loss on purchaser from date and time of auction. Balance of the purchase price must be paid by cashier's check within 15 days from sale date. Except for Virginia Grantor tax, all settlement costs and expenses are purchaser's responsibility. Taxes are pro-rated to the date of sale. Purchaser is responsible for obtaining possession of the property. If purchaser defaults, deposit may be forfeited and property resold at the risk and cost of the defaulting purchaser who shall be liable for any deficiency in the purchase price and all costs, expenses and attorney's fees of both sales. If Trustee does not convey title for any reason, purchaser's sole remedy is return of deposit without interest. This sale is subject to post-sale audit of the status of the loan secured by the Deed of Trust including but not limited to determining whether prior to sale a bankruptcy was filed, a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser's sole remedy shall be return of deposit without interest.
