TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated May 21, 2009, and duly recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed of Trust Book 2373, at Page 114, Billy G. Smelser and Michael A. Austin did convey unto Richard A. Pill, Esq., Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at 400 West Stephen Street, in Martinsburg, West Virginia, on

July 13, 2026, at 10:18 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Gerrardstown District, Berkeley County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of real estate, with the improvements and appurtenances thereunto belonging, situate in Gerrardstown District, Berkeley County, West Virginia, more particularly described as follows:

Lot No. 75 of Phase VII, Cressen Run Subdivision, containing 5.0040 acres, more or less, as more fully shown on that certain plat prepared by Gates Associated, July 9, 1992, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Plat Cabinet 5, at Slide 58, et seq. TOGETHER WITH a right of way ingress to and from said lot as same is set forth on the aforesaid plat.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1117 Driftwood Drive, Gerrardstown, WV 25420.

AND BEING the same real estate which was conveyed to Billy G. Smelser and Michael A. Austin, by deed dated November 23, 2005, from Telena A. Spies and James M. Seibert, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 819 at Page 211.

The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
