TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 15, 2018, and duly recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia, in Document No. 201800002569, in Book No. 857, at Page 1581, Ramon M Cabanas and Jasmine A Hatch did convey unto Zagula Law Office, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated November 8, 2019 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Mortgage Solutions of Colorado, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Hancock County Courthouse in New Cumberland, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03-Clay District, Hancock County, West Virginia, and more particularly described as follows:
All that certain piece or parcel of land, situate in the District of Clay, County of Hancock, and State of West Virginia more particularly described as follows:
Beginning at a stone monument, said monument being the northwest corner of the farm now owned by William S. Glass, said farm being on record in the Clerk’s Office of the Hancock County Court, Deed Book No. D, page 486 of the records of said County, thence from said described point of beginning S. 71 deg. 30′ E. 433 feet to a point in the center of the road or highway, known as the Wylie Ridge Road thence with the center line of said road S. 23 deg. 35′ W. 413.9 feet to a point, thence S. 10 deg. 00′ W. 65.2 feet to a point, thence S. 11 deg. 30′ E. 81.6 feet, to a point, thence S. 27 deg. 30′ E. 104.8 feet to a point, said point begin in the southeast corner of the land being described thence leaving the road or highway and with lands of the grantor N. 73 deg. 05′ W. 655.00 feet to a stone in the center of small run, thence N. 30 deg. E. 651 feet to the point of beginning. Said land being sold from the northwest corner of said far and containing 6-9/10 acres more or less of land together with a certain 10 feet right of way, said right of way now being a roadway existing and extending from the lands of the said parties of the first part across the southeast corner of the tract hereby conveyed, and connecting with the Wylie Ridge Road, hereinbefore mentioned.
Less and excepting the following described property which was conveyed to William E. Daugherty and Deborah M. Daugherty, his wife, by deed of Oscar Daugherty and Pearl Daugherty, his wife, dated the 1st day of July 1981, and of record in the Office of the Clerk of the Hancock County Commission, West Virginia, in Deed Book 186, at Page 12:
All that certain tract or parcel of land situate in the District of Clay, County of Hancock, and State of West Virginia more particularly described as follows:
Beginning at a point in the southeast corner of the grantors’ 6.9 acre parcel, said point being in Wylie Ridge Road; thence with the grantors’ south line passing through a pipe, a distance of 18 feet N. 73 deg. 05’W. 655 feet to a steel fence post in the center of a small run, said point being in the east line of McIntosh lands; thence with a fence row along the east line of McIntosh lands, N. 30 deg. 30′ E. 120 feet to a point; thence, through the lands of the grantors passing through an iron pin, a distance of the 501.30 feet, S. 80 deg. 27′ E 514.52 feet to a point in the centerline of Wylie Ridge Road, thence with the centerline S. 10 deg. W. 36.7 feet to a point; thence S. 11 deg. 30′ E. 104.8 feet to the place of beginning, containing 2.0 acres, more or less.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 5637 Wylie Ridge Rd, New Cumberland, WV 26047.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
