PUBLIC HEARING NOTICE

In accordance with Chapter 8A, Article 5, Section 8 of the Code of West Virginia 2004, as amended, the Berkeley County Planning Commission will hold a public hearing to consider the public comments on the following projects:

REQUEST FOR FINAL PLAT APPROVAL: Southside Towns: The project is directly adjacent to Winchester Avenue (U Rt. 11), approximately 150′ north from the intersection with Sofia Lane, in the Arden Tax District. The final plat proposes 12 townhouse lots on 1.3 acres, to be served by public water and sewer. File# 2505-137

REQUEST FOR FINAL PLAT APPROVAL: Communities of Burwell, Phase 16, Lots A68-A93, B1-B16, B32, C1-C13: The site is located at the end of Caracas Boulevard, 4,000′ north of intersection with Nipetown Road (WV Rt. 8), in the Falling Waters Tax District. The final plat proposes 56 residential lots (single-family) on approximately 19.3 acres, to be served by public water and sewer. File# 2601-003

REQUEST FOR FINAL PLAT APPROVAL: Lakes at Martinsburg Ph.3 Lots 195-287: The site is located off Weaver Lane, approximately 0.80 miles from Williamsport Pike (US Rt. 11), in the Opequon Tax District. The final plat proposes 122 single family detached lots, on approximately 45 acres, to be served by public water and sewer. File# 2602-044

REQUEST FOR DETAILED SITE PLAN APPROVAL: Hatchery Road Water Storage Tank: The project is located along the north side of Hatchery road, approximately 0.7 miles East of U.S. Route 11, in the Mill Creek Tax District. The developer is proposing a freestanding water tank on 1.95 acres. File# 2508-235

REQUEST FOR DETAILED SITE PLAN APPROVAL: Vanville Church of Christ: The property lies on the northeast intersection of Airport Road (Rt.34/3) and Classic Vanville Road (Rt. 34/1), in the Arden Tax District. The developer is proposing a one-story 10,500 square foot church building with parking facility on 7.71 acres, to be served by public water and sewer. File# 2512-349

REQUEST FOR DETAILED SITE PLAN APPROVAL: James Crites Kennel: The site is located at 258 Jacobs Road, approximately 1,300 feet north of Myers Bride Road, in the Opequon Tax District. The developer is proposing a 1,680 sq. ft. commercial dog kennel on approximately 2 acres, to be served by private well and septic. File# 2604-197

REQUEST FOR DETAILED SITE PLAN APPROVAL: Cardinal Pointe – Section 8, Phase 1: The site is located along the west side of Saint Andrews Drive (WV Rt. 3/1) and contiguous to the existing Cardinal Pointe community, in the Falling Waters Tax District. The developer is proposing 234 residential lots (144 single family and 90 townhouse lots) on approximately 118 acres, to be served by public water and sewer. File# 2601-012

REQUEST FOR WAIVER: Sharon Hutzler: The site is located at 1976 Nadenbousch Lane (WV Rt. 34) approximately half a mile southeast from its intersection with Shiley Road (WV Sec. Rt. 34/1) and Near Bethels Way (WV Sec. Rt. 34/1), in the Arden Tax District. The developer is requesting a waiver to Section 505.d, of the Subdivision and Land Development Ordinance (2025), requiring a 50′ right-of way/easement from the proposed administrative subdivision lot(s) to a WVDOH right-of-way. The PUBLIC HEARING will be held on Monday, August 3, 2026, in the County Commission Chambers, 400 West Stephen Street, in the City of Martinsburg at 6:00 p.m. All persons and agencies having an interest on said plats are invited to participate in this hearing and make their comments known.

In the event that an unforeseen circumstance would cause the Planning Commission to cancel the scheduled meeting, a back-up public hearing date Monday, August 17, 2026 will be utilized.
