The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 29, 2021, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1291, at Page 95, Anthony T. Hoff did convey unto Merendino Law, PLLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on
July 28, 2026, at 4:34 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Marion County, West Virginia, and more particularly described as follows:
All of the following described parcels of real estate, together with the improvements thereon and the appurtenances thereunto belonging, being three (3) lots of real estate, adjoining each other, and two story frame dwelling house thereon, situate in Section 3 in the Monongahela Industrial Company's Addition to the City of Fairmont, Union District, in Marion County, West Virginia, that is to say:
Lots numbered respectively 618, 619, 620, each fronting fifty (50) feet on Bungalow Street, and each extending back one hundred and fifty (150) feet to the line of Clark Street; the entire parcel hereby conveyed making one tract of land in the form of a square, being 150 feet square, and containing 22500 square feet.
This conveyance is made together with all buildings and improvements, rights, roads, ways, easements, privileges, appurtenances, and advantages thereunto belonging or in any way appertaining.
The real estate is subject to all exceptions, reservations, easements, covenants, conditions, agreements, land use regulations, rights-of-way, restrictions, servitudes, municipal ordinances, prior out conveyances, prior conveyances of minerals and rights to extract the same, mineral severances and limitations of use as have been exposed upon such property, and those shown on all recorded plats of survey, of record affecting the real estate, to the extent the same are now in effect.
Being the same lots or parcels of real estate conveyed to Paul Spatafore and K. Marie Spatafore, as joint tenants with the right of survivorship, by Stephanie L. Lantz, by the General Warranty Deed dated August 22, 1984, and of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Deed Book 855, at Page 443.
Thereafter, the said Paul Anthony Spatafore died on or about October 4, 2011 per the Appraisement of the Estate, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Record of Inventories and Estates Book 435, at Page 571. Upon his death, Paul Anthony Spatafore's interest in the subject real estate vested in K. Marie Spatafore pursuant to the terms of the aforementioned Deed.
Thereafter, the said Marie Kaptola Spatafore, also known as, Kaptola Marie Spatafore died on or about February 11, 2021 per the Appraisement of the Estate, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia in Record of Inventories and Estate Book 486, at Page 297. Pursuant to the terms of her Last Will and Testament, of record in said Clerk's Office in Will Book 164, at Page 370, Marie Kaptola Spatafore, also known as, Kaptola Marie Spatafore devised her interest in the subject parcels of real estate to Pameal Joyce Galik, Patricia Sue Dickenson, and Paul Sameul Spatafore, if they survive her, or to the survivors among them.
Paul Samuel Spatafore having predeceased Marie Kaptola Spatafore, also known as Kaptola Marie Spatafore, on or about December 5, 2019, thereby vesting the subject property in Pamela Joyce Galik and Patricia Sue Dickenson, also known as Patricia Sue Dickinson, to be recorded simultaneously with the recording of the Deed of Trust.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 618 Boulevard Avenue, Fairmont, WV 26554.
AND BEING the same real estate which was conveyed to Anthony T. Hoff, by Deed dated November 27, 2021, from Pamela Joyce Galik and Patricia Sue Dickenson aka Patricia Sue Dickinson, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1293 at Page 410.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
