NOTICE OF SPECIAL
COMMISSIONER SALE
Pursuant to the authority vested in the undersigned by Order of the Circuit Court of Randolph County, West Virginia, entered in the 29th day of April 2026, in Civil Action No. 2025- C-149, entitled Estate of Edward Junior Markley, by James Markley, in his role as Administrator and Billy R. Belcher, in his role as Director of Valley Volunteers, Inc. vs. Unknown Members of Valley Volunteers, Inc., Valley Unit Emergency Squad Volunteers, Jeff McCauley and Carolyn Meade, as Special Commissioners of said Court, shall on the 24th day of July, 2026, at 1 p.m. proceed to sell at public auction at the front door of the Randolph County Courthouse to the highest bidder(s), the following two tracts of real estate, together with any buildings, structures and other improvements situate thereon and any and all appurtenances located on the real estate herein, being more particularly bounded and described as follows:
Tract One:
A certain lot or parcel of real estate situate in Mill Creek Corporation, Randolph County, West Virginia, being more particularly bound described as follows:
BEGINNING at a point on Allen Street, at a ditch where is situated a water well; thence 61 feet in an easterly direction, with Allen Street, to the southeastern corner of a garage; thence northerly, for a distance of 103 feet, with the eastern side of said garage, to a workshop owned by the parties of the first part; thence westerly, for a distance of 16 feet, with the southern side of said workshop, to the southwestern corner of said workshop; thence northerly, for a distance of approximately 21 feet, running for approximately 10.6 feet with the western side of said workshop, to the banks of Mill Creek; thence westerly, for a distance of approximately 45 feet, along the banks of Mill Creek, to a ditch which is a corner of Carl Daniels and Ruth Daniels; thence southerly, for a distance of 124 feet, with the line of Carl and Ruth Daniels, to the place of beginning.

Those certain parcels or lots of land situate in the town of Mill Creek in Huttonsville District, Randolph County, West Virginia, together with all appurtenances and improvements situate thereon and thereunto belonging and more particularly bounded and described as follows:

BEGINNING at a point on the northeast edge of Conrad Street at the end of an old wire fence where the concrete sidewalk ends: being a corner common to Ethel Taylor. Set a 5/8″ x 36″ iron rod with a cap stamped “L.L.S. No. 6”.
THENCE with a line of said Taylor and old wire fence:
N 28 06′ E. passing post at the end of wire fence at 378.9 feet. IN ALL 283.9 feet to a point on the southwest edge of Mill Street. Set a 5/8″ x 36″ iron rod with a cap stamped “L.L.S. No. 6”. THENCE along Mill Street:
N 64 16′ E 118.64 feet to a point on the southwest edge of Mill Street near the end of a board fence: being a corner common to Evelyn A. Bell. et al. Set a 5/8″ x 36 iron rod with a cap stamped “L.L.S No. 6”.
THENCE three lines with said Bell. et al.:
S 28 31′ W 158.87 feet to a point near the corner of the board fence. Set a 5/8″ x 36″ iron rod with a cap stamped “L.L.S. No. 6”.
S 66 11’E 30.00 feet to a point about 3.0 feet east of corner of board fence. Set a 5/8″ x 36″ iron rod with a cap stamped “L.L.S. No. 6”.
S 28 31′ W. passing an iron rod on the original line between Bell and McLaughlin at 20.00 feet. IN ALL. 89.00 feet to a point about 2.5 feet southeast of the fence corner: being a corner common to Mark McLaughlin. Set a 5/8″ x 36″ iron rod with a stamped “L.L.S. No. 6”.
THENCE two lines with McLaughlin:
N 66 11′ W 30.00 feet to a point about 1.5 feet south of the fence corner. Set a 5/8″ x 36″ iron rod with a cap stamped “L.L.S. No. 6”.
S 28 31′ W, running along the northwest edge of a retaining wall, 131.14 feet to a point on the northeast edge of Conrad Street on the concrete sidewalk. As Witness corner, set a 1/2″ x 20″ iron rod at the northeast edge of the sidewalk on the property line, from which the true corner bears S 28 31′ W 0.5 foot.
THENCE with the northerly edge of Conrad Street:
N 66 43′ W 116.42 feet to the point of BEGINNING, containing 1.09 acre.

1. Said sale will be held at the Randolph County Courthouse, in Elkins, Randolph County,
West Virginia.

2. Each tract of real estate will be sold separately.
3. The sale shall be made with special warranty of title and subject to all reservations, exceptions, covenants, restrictions, easements, limitations, conditions, mineral rights, rights of way of easements, and other servitudes, if any, made, retained or otherwise created by deeds or other instruments constituting the record chain of title to the real estate aforesaid.
4. The sale shall be made subject to any and all liens and encumbrances affecting the real estate, to all unpaid or any accrued real estate taxes assessed against the estate.
5. All real estate, and any improvements located thereon, are sold in “AS IS” condition and are FINAL. The Special Commissioners do not make any representations or warranties as to the physical condition of the real estate. Prospective purchasers are responsible for inspecting the title to the real estate prior to the Special Commissioner Sale. Special Commissioners make no representation regarding the state of title to the real estate.
6. All settlement fees, costs of conveyance, examination of title, title fees and recording charges shall be at the expenses of the purchase.
7. The purchaser shall be solely responsible for removing any existing tenants or persons occupying the real property, as well as any personal property remaining on the real property after the sale. The Special Commissioners shall be under no duty to cause any existing tenants or persons occupying the property to vacate said property, nor shall the Special Commissioners have a duty to cause any personal property and/or belongings remaining at the real property to be removed.
8. Approval of the Circuit Court: This sale is subject to the approval and confirmation by the Circuit Court of Randolph County, West Virginia. The hearing to confirm this sale has been set for September 2, 2026, at 1:00 p.m. in front of Honorable Judge Jack Alsop with possession given
Page 3 of 4 thereafter. Said hearing shall occur at the Upshur County Courthouse, 40 West Main Street, Buckhannon, West Virginia, 26201.
9. Terms of sale: Ten (10.00%) of purchase price due on day of sale by certified check, payable to the Special Commissioner and the balance in immediately available funds at closing, which shall be within seven days of approval of the Circuit Court. The Special Commissioners reserve the right to accept or reject such other terms as to payment or delivery of payment as may be agreed to by the Special Commissioners and the bidder(s).
9. If the successful bidder(s) fails to deliver the deposit and/or total purchase price within the prescribed time, the Special Commissioners may proceed to resell the real estate, or the applicable portion thereof, or, at the discretion of the Special Commissioners convey the real estate to the next highest bidder if such bidder will honor said bid.
