TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated October 30, 2007, and duly recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia, in Book No. 579, at Page 53, Derik L Smith and Janet L Smith did convey unto Pam Smoljanovich Attorney At Law, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 15, 2020 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Home Savings Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Hancock County Courthouse in New Cumberland, West Virginia, on
February 21, 2020 at 9:30 AM
the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Grant/Newell District, Hancock County, West Virginia, and more particularly described as follows:
A certain parcel of land situate upon the southern side of Arner Road, located in the Grant District of Hancock County, West Virginia, bounded and being more particularly described as follows:
BEGINNING for the same at a found iron bar located on the south side of Arner Road at the northeast corner of a 4.40 acre tract of land that was conveyed to Paul L. Wittenberg and Judy A. Wittenberg, Trustees of the Paul L. Wittenberg and Judy A. Wittenberg Restated Joint Revocable Trust by a deed dated January 8, 1999 and recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia in Deed Book 244 at Page 667. Said point if also located at the most northern corner of the parcel of land to be described herein.
Thence, from the said place of beginning, and with the said 4.40 acre tract of land, S. 29 deg. 00′ 45″ W. passing and iron bar found on line at 179.37 feet, for a total distance of 537.26 feet to an iron bar found. Thence, with the same, S. 4 deg. 00′ 15″ W. for a distance of 171.47 feet to a found iron bar. Thence leaving the last mentioned 4.40 acre Wittenberg tract of land, and now through the 4.43 acre tract of land that was originally conveyed to Will Mink and Bertha Mink, his wife, by deed of Oran C. Smith and Beulah Smith, his wife, by a deed dated March 16, 1950 and of record in the aforesaid Clerk’s Office in Deed Book 75 at Page 158, from which the parcel of land described herein was therein excepted and reserved out. Thence, N. 29 deg. 00′ 45″ E. for a distance of 673.12 feet to a found iron bar located on the south side Arner Road. Thence, with the said road, N. 45 deg. 53′ W. for a distance of 75.00 feet to the place of beginning, containing 1.00 acres, more or less, as shown upon a plat attached hereto and made a part of this description.
Being the same parcel of land that was conveyed to West Virginia Farms, LLC, by a deed dated January 2006 and recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia in Deed Book 276 at Page 620.
The above described parcel of land is subject to all exceptions, conditions, stipulations, and reservations found in this deed and all prior deeds of record and also to all rights of ways and easements of record.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 74 Arner Rd, Chester, WV 26034-1865.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
