Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated January 24, 2017, and of record in the Office of the Clerk of the Ohio County Commission in Deed of Trust Book 1539 at page 429, will sell at public auction to the highest bidder on:
March 4, 2020
at 10:00 a.m.
at the front door of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia, that certain property conveyed by Megan Walker Brooks to Ronal W. Rush, Trustee, by Deed of Trust dated October 16, 2015, and recorded in the office of said Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1514, at page 171, and being described as follows:
The following described property that is to say:
That piece or parcel of an known as Lot Number Four (4) on the Plat of Park View, which said plat is recorded in the Office of the Clerk of the County Court of Ohio County, West Virginia in Plat Book 1, page 7. Said Lot Numbered Four (4) being fifty (50) feet wide on the Elm Grove and Boggs Hills Road running back with the same width 253.9 feet to Alley “A” in the rear, together with buildings and improvements thereunto belonging.
But this conveyance is subject to a provision that no building shall at any time be erected or extended on the aforesaid lot nearer to the road than the building line which has been established and is shown on the said plat.
This conveyance is made subject to exceptions, reservations, restrictions, covenants, conditions, easements and rights-of- way referred to or contained in this deed, any aforementioned deeds and all prior conveyances of record.

Being the same property conveyed to Megan Walker Brooks by Douglas S. Glover and Sherry Laughlin Glover, husband and wife, by Deed dated October 20, 2008, and recorded in Ohio County Deed Book 789, at page 368.
The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
