LEGAL NOTICE
In the Court of Common Pleas of Belmont County, Ohio located at 101 W Main St, St Clairsville, OH 43950, the plaintiffs Terry Shepherd and his wife Mary Shepherd filed a civil lawsuit to recover personal injuries sustained as a result of a violent incident where Mr. Shepherd was struck by a vehicle and left for dead while delivering food for his employer Meals on Wheels. Mr. Shepherd filed his lawsuit against, Ray B. “R.B.” Shaver and James Allen, Jr., in case number 19CV0135 which is pending before the Honorable Frank A. Fregiato. James Allen, Jr.’s address is unknown. The Plaintiff’s Complaint alleges that on April 14, 2017 at or around 11:30 a.m., plaintiff Shepherd was delivering meals to the elderly and infirm in Shadyside, Belmont County, Ohio for Belmont County Senior Services. Plaintiff alleges that defendant James Allen, Jr. struck plaintiff Terry Shepherd while he was exiting the meals on wheels vehicle and standing next to the door of the vehicle with a silver pickup truck owned by defendant Ray B. “R.B.” Shaver rolling him down the side of the motor vehicles, causing his body to break of the drivers side mirror and serious, permanent and chronic injuries, damages and losses to Mr. and Mrs. Shepherd. Among those injuries are a fractured left hip, injured left foot, injured left ankle, injured left knee, a hematoma to his left lower abdomen, injuries to his fingers from attempting to catch himself upon being thrown to the ground, an injury and/or hematoma to his neck with bleeding on the left side. The Plaintiffs seek compensatory and punitive damages for their personal injuries against the defendants, Ray B. “R.B.” Shaver, James Allen, Jr., and Joe Doe Individuals and/or Entities, jointly and/or severally, in an amount in excess of the jurisdictional threshold of the Court of Twenty- Five Thousand Dollars ($25,000.00) and in a sum sufficient to make each of them whole for all injuries and damages sustained by them and/or to be suffered by them in the future; for an award of punitive damages in excess of the jurisdictional threshold of the Court of Twenty- Five Thousand Dollars ($25,000.00) and in a sum sufficient to punish the defendants for their conduct and dissuade them and other from engaging in similar conduct in the future; for attorney’s fees and costs where allowable by law; for pre- and post- judgment interest where allowable by law; and for such additional favorable relief as the Court deems just and appropriate. Defendant James Allen, Jr. is required to answer or respond within twenty- eight (28) days after the publication.
