TRUSTEE’S NOTICE
OF SALE

By virtue of that certain Deed of Trust made by James H. Wilson to John E. Gompers, Trustee, dated the 25th day of November, 2015, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1516, at page 372, and that certain Appointment of Successor Trustee, dated the 15th day of May, 2020, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1602, at page 660, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 24th day of June, 2020, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, a certain parcel of land more particularly described as follows:

PARCEL 1
A piece of property situated in Triadelphia District, Ohio County, West Virginia, that is to say: Lot number sixty-four (64) fronting on Forest Avenue, in the addition to Cedar Rocks as shown on the plat of Cedar Rocks, which plat is of record in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 1, at page 195.

PARCEL II
That certain lot or parcel of ground shown and defined as Lot Numbered Seventeen (17) on the plat of the first addition to Cedar Rocks, which plat is recoded in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book No. 1, page 195, said Lot Numbered Seventeen (17) fronting on Forest Avenue.

The coal underlying said last mentioned lot is excepted and reserved and not hereby conveyed.

This conveyance is subject, however, to the following understanding and on the condition that building line has been established on the lots in said addition, and that the grantee will not erect, or suffer, permit or cause to be erected, within the space of fifteen (15) feet measured from the front line of the lot hereby conveyed, any building or structure exception an open porch, piazza or stoop.

PARCEL III
All those certain lots or parcel of ground situate in Triadelphia District, Ohio County, West Virginia, as shown and defined as Lots Numbered Eighteen (18) and Nineteen (19), each fronting on Forest Avenue, on the Plat of “First Addition to Cedar Rocks” which said Plat is recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 1, at page 195.

The coal underlying said land is excepted and reserved and not hereby conveyed.

Said property is conveyed upon the condition that the Grantee will not erect, suffer, permit or cause to be erected within the space of Fifteen (15) feet measure from the line of the lots hereby conveyed, any building or structure except an open porch, piazza or stoop.

PARCEL IV
All those certain lots or parcels of ground situate in Triadelphia District, Ohio County, West Virginia, shown and defined as Lots Numbered Sixty-five (65) and Sixty-six (66), both fronting on Forest Avenue, on the Plat of “Cedar Rocks”, which said plat is recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book No. 1, at page 183.

The coal underlying said land is excepted and reserved and not hereby conveyed.

Said lots are subject to a fifteen (15) foot building line from the front thereof, as more particularly set forth in a Deed dated July 29, 1914, and of record in the aforesaid Clerk’s Office in Deed Book 147, at page 498.

Being the same property conveyed to James H. Wilson by Tina Renforth McGreal, Executrix of the Estate of Robert W. Taylor, by deed dated November 18, 2015, and recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 898, at page 160.

TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
