By virtue of that certain Deed of Trust made by Rikki Marie Wesche, now known as Rikki Marie Davis, and John E. Gompers, Trustee, dated the 16th day of September, 2016, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1531, at page 694, and that certain Appointment of Successor Trustee, dated the 15th day of May, 2020, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1602, at page 658, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 24th day of June, 2020, at 10:15 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, a certain parcel of land more particularly described as follows:
The following described property situated in the County of Ohio and State of West Virginia, and known as 443 North Front Street, that is to say:
A part or parcel of the Lot Numbered 8 in George Zilles’ Addition to the City of Wheeling, a plat of which addition is of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 69, page 425, as a part of the deed made by George B. Caldwell, Trustee to Thomas Prince dated the 5th day of January, 1880; the part or parcel of said Lot Numbered 8 which is hereby conveyed is bounded as follows, to-wit: Beginning at a point in the east boundary line of said lot distance 30 feet southwardly from the northeast corner of said lot running thence in a southerly direction with and along said east boundary line 30 feet to a point thence westwardly and parallel to the north and south boundary lines of said lot to a point in the west boundary line thereof thence in a northerly direction along and with the said west boundary line thereof thence in a northerly direction along and with the said west boundary line 30 feet to a point, thence in an easterly direction and parallel to the said north and south boundary lines to the place of beginning.
This conveyance is however subject to all exceptions, reservations, restrictions, covenants, conditions, rights-of-way, easements, if any, granted by or acquired from the parties of the first part and their predecessors in title to said property, and other matters appearing in prior instruments of record.
Being the same property conveyed to Robin J. Wesche and Rikki Wesche from Branch Banking and Trust Company (BB&T) by Deed dated November 26, 2012, and recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 848 at page 681.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
