TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 26, 2002, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Book No. 1170, at Page 370, Pamela S. Ryder and John F. Ryder did convey unto Richard Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated May 28, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Bethlehem District, Ohio County, West Virginia, and more particularly described as follows:
The following described property located in Ritchie Country District, Ohio County, West Virginia, that is to say: Beginning at a point in the easterly line of a sixteen foot alley in the rear of said Lots Numbered Four (4) and Five (5), which point is South 65 degrees 41 minutes East Sixteen (16) feet from the Northeast corner of said Lot Numbered Five (5); thence running South 65 degrees 41 minutes East One Hundred Seventy-Five and Twenty-Nine Hundredths (175.29) feet to a point in what was formerly the Fisher Line; thence South 59 degrees 35 minutes West One Hundred Twenty-Two and Forty-Eight Hundredths (122.48) feet to a point in said Fisher Line; thence running North 65 degrees 41 minutes West One Hundred Four and Fifty-Seven Hundredths (104.57) feet to a point in the Easterly line of said alley, which point is South 65 degrees 41 minutes East Sixteen (16) feet from the Southeast corner of said Lot Numbered Four (4); thence running North 24 degrees 19 minutes East One Hundred (100) feet to the place of beginning. The property herein last above-described are the two lots immediately East of said Lots Numbered Four (4) and Five (5), shown and designated on said subdivision of Woodward Schmidt Farm recorded in Plat Book No. 2, at page 48. There is excepted and reserved, however, from this conveyance the bituminous coal (and stone) underlying the parcel of the property hereinabove described, the same being reserved by a former Grantor. This conveyance is further subject to the Right of Way mentioned and contained in the agreement between Woodward Schmidt and Emma Schmidt, of the one part, and M. E. Phillips and E. E. Golden, their heirs and assigns, of the other part, bearing the date the 19th day of August, 1923, and recorded in said Clerk’s Office in Deed Book No. 189, at page 447. This conveyance is further subject to the right given to the Chesapeake and Potomac Telephone Company of West Virginia, to construct, operate and maintain its lines of telephone and telegraph by the said Woodward Schmidt and Emma Schmidt, by instrument dated the 10th day of July, 1929, and recorded in the aforesaid Clerk’s Office in Deed Book No. 218, at page 449. Being the same property which was heretofore conveyed to John F. Ryder and Iris M. Ryder, his wife, by John L. Vensel, Jr. and Elizabeth Anne Vensel, his wife, by a Deed dated the 16th day of July, 1991, and recorded in the aforesaid County Clerk’s Office in Deed Book No. 662, at page 70. The said John F. Ryder and Iris M. Ryder were thereafter divorced in Ohio County, West Virginia. Thereafter, the said Iris M. Ryder conveyed all of her right, title and interest in and to the subject property to John F. Ryder, by a Deed dated the 27th day of October, 1997, and recorded in the aforesaid County Clerk’s Office in Deed Book No. 701, at page 811. The said John F. Ryder now owns fee simple title in and to the subject property.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 7 Zion Lane, Wheeling, WV 26003-4988.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $7,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
