NOTICE OF TRUSTEE’S SALE Pursuant to the authority vested in the undersigned Jeffery D. Taylor, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Harrison West Virginia, and by Deed of Trust dated September 20, 2012, executed by Joshua S. Runyon to Richard A. Pill, Trustee, which deed of trust is of record in the Office of the Clerk of Harrison County, West Virginia, in Trust Deed Book 1249 at Page 994, and pursuant to that certain Security Agreement dated September 20, 2012, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, together with the mobile home described in the Security Agreement, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, and the mobile home described in the Security Agreement and below, at a public auction on September 4, 2020 at 10:00 a.m. to the highest bidder at the front door of the Courthouse of said County of Harrison, in Clarksburg, West Virginia, which real estate is more completely described as follows: All that certain lot or parcel of land, together with the appurtenances thereunto belonging, situate in Oakridge Estates II, in the Town of Lost Creek, in Grant District, Harrison County, West Virginia, more particularly bounded and described as follows: Beginning at a 5/8 inch rebar, set on the southern edge of a proposed 30 foot road and on the eastern right-of-way of Harrison County Route 48, thence running with said edge of proposed road for three lines, N 81 00′ 00″ E l02.00 feet to a 5/8 inch iron rebar, set, thence, N 81 00′ 00″ E 47.89 feet to a 5/8 inch iron rebar, set, thence S 67 59′ 38″ E 92.67 feet to a 5/8 inch iron rebar, set, thence, S 19 06′ 00″ E 81.61 feet to a 5/8 inch iron rebar, set a corner to Lot No 6, and a corner to Lot No 7,thence running with Lot No. 7, S 78 44′ 53″ W 118.08 feet to a 5/8 inch iron rebar, set, a corner to Lot No. 6 and Lot No. 7, thence continuing with lot No 7, S 75 59′ 33″ W 100.83 feet to a 5/8 inch iron rebar, set on the eastern right-of-way of Harrison County Route 48, thence running with said right-of-way, N 19 06′ 20″ W 143.76 feet to the point of beginning, containing 27,791.12 square feet or 0.638 acres, more or less, as determined by a survey conducted in October, 1994, and as shown on plat entitled “Plat of Survey for John E. & Judy K. Lowther, Lot 6” together with a 1999 26 x 52 Skyline ABC-S-1061-CT, Serial #(s) 67-39-0120-MBA. Grantors further grant and convey to Grantee any and all right, title and interest they may have to any rights of ways or easements incident to their ownership of the above described real estate. This conveyance is made subject to all valid reservations, conditions, easements or other servitudes, if any, provided or created in prior instruments of record pertaining to the property hereby conveyed. TERMS OF SALE 1. Cash in hand paid on the day of sale. 2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever. 3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-2. 4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. 6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above. 7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid. 8.
