NOTICE OF PUBLIC HEARING
CITY OF WEIRTON,
WEST VIRGINIA

CARES ACT FUNDING AND THE
FY 2019 ANNUAL ACTION PLAN – SUBSTANTIAL AMENDMENT

As a Federal Entitlement, the City of Weirton, West Virginia (“City”) receives funding from U.S. Department of Housing and Urban Development (HUD) through the Community Development Block Grant Program (CDBG) Program. Through the March 27, 2020 passage of the Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136, the City of Weirton will receive an allocation of CDBG-CV funds. The City will receive $249,843 in Community Development Block Grant – Coronavirus (CDBG-CV) funds.

The purpose of this public hearing is to present substantial amendments to the City of Weirton’s FY 2019 Annual Action Plans for the use of prior year CDBG and CDBG-CV funds.

To expedite the disbursement of the City’s prior year CDBG and FY 2020 CDBG-CV funds, via 24 CFR 5.110, the CARES Act authorizes HUD to grant waivers to the public notice, public comment, and citizen participation plan requirements found in 24 CFR 91.105I(2) and (k), 24 CFR 91.115I(2) and (i) and 24 CFR 91.401. In accordance with the City of Weirton’s Citizen Participation Plan and HUD’s regulatory requirement, waivers are granted which reduces the minimum 30-day public comment period to a 5-day period, a public hearing will be held at 11:00 A.M. prevailing time on September 8, 2020 in Room 201 of the Weirton Municipal Building, 200 Municipal Plaza, Weirton, WV 26062. The Weirton Municipal Building and Common Council Chambers are accessible to persons with physical disabilities. If special arrangements need to be made to accommodate residents in order for them to participate in the public hearing, please call Mr. Kaleb Knowlton, Program Manager, Planning and Development Department, at (304) 797-8500 Ext. 1019 to make arrangements.

The City of Weirton adopted its FY 2019 Annual Action Plan and Budget for the use of CDBG funds on July 8, 2019. In accordance with CDBG program regulations, the City is allowed to make substantial amendments to its Annual Action Plan and Budget in accordance with the City’s Citizen Participation Plan.

The City has determined that it is necessary to amend the approved CDBG program budget for the previously approved program year for FY 2019. The funds will be reprogrammed from projects/activities that will be cancelled to proposed new projects/activities, and/or to increase funding for other previously approved projects/activities.

This is considered a substantial amendment in accordance with the City’s Citizen Participation Plan as the following applies: the scope, purpose, and location of the project activity have changed.

The substantial amendment to the FY 2019 Annual Action Plans are proposed as follows:

Amended FY 2017-2019 CDBG Activities:

*CD-17-06 Dunbar Recreation Center – Craft Supplies – delete this project/activity in its entirety and reallocate a total of $500.00 to a new project/activity.
*CD-17-10 Dunbar Recreation Center – Safety Upgrades – delete this project/activity in its entirety and reallocate a total of $900.00 to a new project/activity.
*CD-18-09 Dunbar Recreation Center – ADA Ramp, Door, and Bathroom – delete this project/activity in its entirety and reallocate a total of $40,000.00 to a new project/activity.
*CD-19-04 Dunbar Recreation Center – Building Insurance – delete this project/activity in its entirety and reallocate a total of $2,500.00 to a new project/activity.
*CD-19-09 Weirton Park Board – New Park – increase the project/activity budget by $93,900 for a new project/activity budget of $135,048.00.
*CD-19-10 CDBG Eligible Street Improvements – reduce this project/activity budget by $50,000 for a new project/activity budget of $200,000.00.

FY 2020 CDBG-CV Activities:

*CDBG-CV-20-01 Administration – funds to administer $10,000 the CDBG-CV funds.
*CDBG-CV-20-02 Rental Assistance Program – funds for rental $75,000 assistance programs.
* CDBG-CV-20-03 Utility Assistance Program – funds for utility $50,000
assistance programs.
*CDBG-CV-20-04 Food Program – funds for food programs $75,000
*CDBG-CV-20-05 Personal Protective Equipment Supplies – $39,843
funds for personal protective equipment (PPE) supplies. Total CDBG-CV: $ 249,843

The FY 2019 Annual Action Plan – Substantial Amendment is on public display for viewing by the public for a period of at least 5 days beginning on Friday, August 21, 2020 and ending on Tuesday, September 8, 2020 at the City of Weirton’s website: https://www.cityofweirton.com

All interested residents are encouraged to attend this public hearing and they will be given the opportunity to present oral or written testimony concerning the proposed amendment to the use of CDBG and CDBG-CV funds under the FY 2019 Annual Action Plan. All comments received by September 8, 2020 by 4:00 p.m. will be considered by the City of Weirton prior to submittal of the substantial amendment to City Council at their Tuesday, September 8, 2020 City Council Meeting. Once approved, the City intends to submit the substantial amendment to HUD on or before September 11, 2020.
