The purpose of this notice is to satisfy two (2) separate but related procedural requirements for activities to be undertaken by the City of Weirton, WV.
REQUEST FOR RELEASE OF FUNDS
On or about January 27, 2021, the City of Weirton will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended, to undertake a project funded under the FY 2017, FY 2018, FY 2019, and FY 2020 Programs for the purpose of developing a new park in the Fourth Ward of the City of Weirton.
ASSESSED PROJECT
Weirton New Park Development. CDBG funds will be used to acquire property to develop a new park in the Fourth Ward. Park construction will include a high school regulation sized basketball court, apron, fencing, courtside benches, picnic tables, ADA accessible walkways, and landscaping. Funds will also be used for architectural and engineering costs. The City of Weirton will allocate $1,400 of FY 2017, $40,000 of FY 2018, $93,648 of FY 2019, and $59,538 of FY 2020. The total CDBG fund allocation to the project is $194,586
FINDING OF NO SIGNIFICANT
IMPACT (FONSI)
The City of Weirton has determined that the above-identified project will have no significant impact on the human environment. Therefore, an Environment Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the City of Weirton, 200 Municipal Plaza, Weirton, WV 26062, and is available for public examination and copying, upon request, during normal business hours Monday through Friday.
The activity listed above is assessed under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. Additional project information is contained in the respective project ERR on file and which is available for review or copying at the same location and time specified in the preceding FONSI statement.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Weirton, 200 Municipal Plaza, Weirton, WV 26062 or by email to: [email protected]. All comments received by January 26, 2021 will be considered by the City of Weirton prior to authorizing submission of a request for release of funds. Commenters should specify which part of this Notice they are addressing.
ENVIRONMENTAL
CERTIFICATION
The City of Weirton certifies to HUD that the Hon. Harold Miller, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process, and these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Weirton to use CDBG funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the City of Weirton’s certification received by February 11, 2021, or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following basis: (a.) the certification was not executed by the Certifying Officer of the City of Weirton; (b.) the City of Weirton has omitted a step or failed to make a decision or finding required by HUD regulations are 24 CFR Part 58; (c.) the City of Weirton or other participants in the development process have committed funds, incurred costs, or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d.) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project are unsatisfactory from the standpoint of environmental quality.
