NOTICE OF
SUBSTITUTE TRUSTEE’S SALE
By virtue of the authority vested in the undersigned Trustee under that certain Credit Line Deed of Trust and Security Agreement, (hereinafter referred to as deed of trust) dated May 21, 2008, made and executed by PAMELA G. WOOD, as Executive Director for HOUSING CONNECTIONS, INC., to BB&T Collateral Service Corporation, Trustees for BRANCH BANKING AND TRUST COMPANY, NATIONAL ASSOCIATION, a North Carolina banking corporation, which said deed of trust is of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in General Lien Book 1353, at page 540, said deed of trust providing that either Trustee may act thereunder, and that certain Substitution of Trustee dated the 2nd day of March, 2015, of record in said Clerk’s Office in General Lien Book 1500, at page 798, and default having been made in the payment of the indebtedness secured by said deed of trust, and being requested so to do by the holder and owner of the indebtedness and the note evidencing same, thereby secured, and the provisions in said deed of trust pertaining to acceleration having been complied with by the present holder of the note, the undersigned Trustee will sell at public auction, at the front door fronting on Main Street of the Courthouse of Ohio County, Wheeling, West Virginia, on:

All those certain tracts or parcels of land situate and being in the City of Wheeling, County of Ohio and State of West Virginia, more particularly described as follows:

123 FOURTEENTH STREET: A certain part of Lot No. Five (5) in Square Twenty-four (24) in the Bellair Addition to the City of Wheeling, Ohio County, West Virginia, bounded and described as follows:

Commencing at the southeast corner of the said lot at the intersection of the west line of Alley F and the north line of Fourteenth Street, Wheeling, Ohio County, West Virginia; thence with the eastern line thereof bind on said alley northwardly the full depth of said lot to the alley in the rear thereof; thence with the northern line of said lot and binding on the last mentioned alley westwardly thirty (30) feet; thence southwardly and parallel with the first described line to the southern or front line of said lot; thence with the said southern or front line along the northern line of said Fourteenth Street eastwardly thirty (30) feet to the place of beginning; together with all and singular the improvements situate thereon and the hereditaments and appurtenances thereunto belonging.

EXCEPTING that certain parcel of real estate conveyed to Joseph G. Morrison, IV, and Michelle J. Morrison, father and daughter, by Housing Connections, Inc., a West Virginia corporation, formerly known as Hopeful Housing, Inc., by deed dated January 7, 2008, and recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 782, at page 276.

BEING a part of the same property conveyed to Hopeful Housing, Inc., a West Virginia Corporation (now known as Housing Connections, Inc.) by Richard Strathern by deed dated June 16, 2005, and recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 761, at page 566.

This conveyance is subject to all covenants, restrictions, rights of way, agreements, exceptions, reservations and oil and gas leases of record. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

The above described real estate is reported to have mailing addresses of: 87 15th Street, Room 438, Wheeling, West Virginia 26003-3548, and assessed for real property taxes as District 10 – Wheeling Tax Map W51, Parcel 0413.

Said sale will be made subject to any unpaid taxes and existing building restrictions, restrictive covenants, exceptions, reservations, conditions, rights of way, easements and servitudes, if any, to which said land has been heretofore subjected, and is further made subject to such rights of way, easements and other matters which would be disclosed by a visual inspection of the premises herein conveyed.

TERMS OF SALE: Cash in hand on day of sale or upon terms to be agreed upon between Substitute Trustee and successful bidder. In the discretion of the holder and owner of the indebtedness, Substitute Trustee may sell the secured property in one or more parcels or tracts and/or Substitute Trustee may sell all or only part of the secured property. Payment of unpaid real estate taxes, assessments and transfer fees and taxes shall be assumed by the purchaser. The Substitute Trustee does not warrant title to this property. The subject property is sold “AS IS,” with all faults and defects, if any. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. Said sale may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same where legal notices are posted for this county. Should the Substitute Trustee not appear at the time appointed for the sale and there is not notice posted of a continuance, please contact the office of the Substitute Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Substitute Trustee. The undersigned is fully vested with the authority to sell said property as Substitute Trustee by instrument of record.
