Kamryn J. Ryan, Plaintiff vs. John D. Nice and John Fitzgerald, Defendants; Civil Action No. 20-C-181, Judge David J. Sims.
The object of the above entitled civil action is to recover compensatory damages for personal injuries and damages, punitive damages, interest and other relief as the Court or jury may find that were sustained by Plaintiff Kamryn J. Ryan as a result of a collision that occurred on the 2ndday of September, 2018 on West Virginia State Route 2 Southbound off-ramp to the 26thStreet collector and Interstate 470 collector, in or about Wheeling, Ohio County, West Virginia, when defendant John D. Nice negligently and carelessly operated a 2001 Jeep Grand Cherokee owned by defendant John Fitzgerald in such a manner as to cause a collision with another vehicle, thereby proximately causing permanent injuries and damages to plaintiff Kamryn J. Ryan, who was a passenger in the vehicle operated by defendant John D. Nice. That appearing by an Affidavit filed in this action, the Plaintiff has used due diligence to ascertain the residence or whereabouts of defendant John D. Nice without effect.
It is so ORDERED that defendant John D. Nice appear and serve upon Shane M. Mallett, Esq., counsel for plaintiff, whose address is: P.O. Box 951, Wheeling, West Virginia 26003, an Answer or other defense to the Complaint filed in the above-styled civil action on or before the 22ndday of February, 2021; otherwise, judgment by default may be rendered against the defendant, and the Court may extend the relief requested in the Complaint at any time thereafter. A copy of the Complaint may be obtained from the undersigned at said Clerk’s Office located at the Ohio County Courthouse, 1500 Chapline Street, Fourth Floor, Wheeling, West Virginia 26003.
