NOTICE OF TRUSTEE SALE
OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by
deed of trust dated the 25th day of June, 1999, signed
by Michael Howell and Sandra Howell, to Pamela
Spencer, Trustee(s), which said deed of trust is of
record in the Office of the Clerk of the County
Commission of Wetzel County, West Virginia, in Trust
Deed Book 255, at page 148, and Golden & Amos,
PLLC, Trustee having been requested so to do by the
Secured Creditor, and default having been made under
the terms and conditions of said deed of trust, and the
provisions in said deed of trust concerning acceleration
having been complied with by the Secured Creditor and
present holder of the note, said Trustee will sell at public
auction at 11:00 o’clock a.m. on the
1st day of MARCH 2021
at the front doors of the Courthouse in Wetzel County in
Martinsville, West Virginia the following described real
estate:
Situate in Green District, Wetzel County, West Virginia,
and more particularly described as follows:
.81 acres as shown on the plat of record in Deed Book
366 at Page 148 which said plat is incorporated by
reference with legal description as follows:
A parcel of land on the west side of the railroad near Big
Fishing Creek and Route No. 20 in Green District,
Wetzel County, West Virginia. Beginning at a point in
the center of the railroad tracks, then with and binding
on land remaining to Edgar H. and Margaret B. Howell
for four (4) lines as shown on Drawing No. 99-10004,
which is made a part of this description, N. 76* 23′ W.
174.01 feet (passing through the center of a large bolt
set at 52.32 feet) to a set large bolt, then N. 5* 50′ W.
112.11 feet to a set mine bolt, then, S. 76* 30′ E., 63.83
feet to a set mine bolt, then N. 13* 17′ E., 63.83 feet to a
set mine bolt, then, S. 76* 30′ E., 221.15 feet (passing
through the center of a mine bolt set at 167.90 feet) to a
point in the center of the railroad tracks then with and
binding on the center of the railroad tracks for four (4)
lines (chords) S. 7* 03′ W., 3.13 feet to a point, then, S.
15* 44′ W., 56.65 feet to a point, then, S. 21* 24′ W.,
66.78 feet to the beginning, containing 0.81 acre, more
or less, which contains a part of the railroad right of way.
There is further granted unto the said second parties,
their heirs and assigns, the right in common with other
to the use of two (2) rights of way, for purposes of
ingress and egress.
The first right of way extending from the
above-described realty to the ford at Big Fishing Creek,
and the second right of way from the above-described
realty to the bridge crossing the creek. Said bridge is
currently a foot bridge, but should a drive-across bridge
be built, said right of way is to extend to the to the
drive-across bridge.
And being a part of the five (5) acres conveyed to Edgar
H. and Margaret B. Howell by deed dated November 4,
1982, and recorded in the office of the Clerk of the
County Commission of Wetzel County, West Virginia, in
Deed Book 304 at Page 315.
There is excepted from the operation of this deed, and
not hereby conveyed, all of the coal and one-half (1/2)
of the oil and gas, together with certain mining and
operating rights and privileges as set out in a certain
deed made by D.H. Cox and duly of record.
This conveyance is also made subject to all other
reservations, exceptions, conditions, grants of rights of
way and easements made by the grantors and their
predecessors in title.
It is the intention of this notice to sell the secured
property by proper description as was intended to be
transferred and conveyed in the aforesaid deed of trust.

To the knowledge of the Trustee this foreclosure sale is
exempt from Coronavirus Pandemic restrictions for the
following reason. Property is vacant or Investor is not
a Governmental Entity. If any party has any
knowledge to the contrary please contact the Trustee.
TERMS OF SALE: Cash in hand on day of sale or
within 30 days of date of sale upon terms to be agreed
upon between Trustee and successful bidder, time
being of the essence; payment for unpaid real estate
taxes to be assumed by the purchaser. The Trustee
does not warrant title or fitness to this property; it is
being purchased as is; this is a buyer beware sale and
any buyer is advised to retain counsel before the sale. If
there is any part of the process of sale which is found to
be objectionable, the Trustee reserves the right to
cancel the sale. No purchaser should take possession
or make improvements in the premises until the Trustee
deed is delivered or recorded. A third-party purchaser at
sale will be required to pay the purchase price plus all
recording and transfer fees.
Trustee at sale is under no duty to cause any existing
tenant or person occupying the subject property to
vacate said property.
FEDERAL TAX LIEN: In the event that there are
Federal Tax Liens against the property, the United
States would have the right to redeem the property
within a period of 120 days from the date of such sale or
the period allowable for redemption under local law,
whichever is longer.
The party(ies) secured by the Deed of Trust reserve the
right to purchase the property at such sale. If the
purchaser at sale is unable to complete the terms of
purchase within 30 days, the Trustee reserves the right
to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time
without any notice other than oral proclamation at the
time and place appointed for this sale or by posting of a
notice of same. Should the Trustee not appear at the
time appointed for the sale and there is no notice posted
of a continuance please contact the office of the Trustee
to make further inquiry. Any sale may be conducted or
adjourned by the designated agent or attorney of the
Trustee. The undersigned is fully vested with the
authority to sell said property as Trustee by instrument
of record.
