The object of the above entitled action is a civil suit for wrongful occupation.
And it appearing by an affidavit filed in this action that David Allen Burns is an individual defendant and the plaintiff has used due diligence to ascertain the residence or where- abouts of the defendants, without effect, via the Sheriff Department service on 2/3/2021 and via Personal Service by summons which was issued on 2/4/2021.
It is ordered that David Allen Burns do serve upon Shannon L Price, magistrate, whose address is 632 Main Street Suite 203 Wellsburg, WV 26070, an answer or other defense to the complaint filed in this action on or before thirty (30) days from the second date of publication, otherwise judgment by default will be taken against David Allen Burns at any time thereafter. A copy of said complaint can be obtained from the undersigned Clerk at her office.
