NOTICE OF PUBLIC HEARING ON
BOND AUTHORIZING ORDINANCE OF
THE CITY OF
WHEELING

A public hearing will be held on the following entitled Ordinance at a regular meeting of the Council of The City of Wheeling (the “City”) to be held on Tuesday, November 17, 2015, at 5:30 p.m. at City Hall, 1500 Chapline Street, Wheeling, West Virginia, and at such hearing any person interested may appear before the City and present protests, and all protests and suggestions shall be heard by the City and it shall then take such actions as it shall deem proper in the premises upon an Ordinance entitled:

AN ORDINANCE AUTHORIZING THE ISSUANCE OF NOT MORE THAN $6,815,000.00 AGGREGATE PRINCIPAL AMOUNT OF OGLEBAY PARK REFUNDING REVENUE BONDS, SERIES 2015, FOR THE REFUNDING OF THE OGLEBAY PARK REVENUE REFUNDING BONDS, SERIES 2003 AMENDED, THE OGLEBAY PARK IMPROVEMENT REVENUE BONDS, SERIES 2004 AMENDED AND THE OGLEBAY PARK IMPROVEMENT AND REVENUE BONDS, SERIES 2004B AMENDED; PROVIDING FOR THE COSTS OF ISSUANCE OF THE ABOVE BONDS; PROVIDING FOR THE RIGHTS AND REMEDIES OF AND SECURITY FOR THE REGISTERED OWNERS OF SUCH BONDS; AUTHORIZING THE SALE AND PROVIDING FOR THE TERMS AND PROVISIONS OF SUCH BONDS; AND ENACTING OTHER PROVISIONS RELATING THERETO.

The above-quoted title of the Ordinance describes generally the contents thereof and the purposes of the Bonds contemplated thereby. The City contemplates the issuance of the Bonds described in the Ordinance. The proceeds of the Bonds will be used to (i) refund the City of Wheeling Oglebay Park Revenue Refunding Bonds, Series 2003 Amended; (ii) refund the City of Wheeling Oglebay Park Improvement Revenue Bonds, Series 2004 Amended; (iii) refund the City of Wheeling Oglebay Park Improvement Revenue Bonds, Series 2004B Amended; and (iv) pay costs of issuance of the Series 2015 Bonds and related costs. The Bonds are payable from the net revenues derived by the Wheeling Park Commission from the management and operation of Wilson Lodge, which is located within Oglebay Park, including the National Training Center for Public Facilties Managers. No taxes may at any time be levied for the payment of the Bonds or the interest thereon.

The above-entitled Ordinance was adopted by the City on November 3, 2015. A certified copy of the above-entitled Ordinance is on file with the City Clerk for review by interested parties during regular office hours.

Following the public hearing, the City intends to enact the Ordinance upon final reading.
