There is now pending in the Circuit Court of Wetzel
County, West Virginia, the abovestyled Civil Action in
which Marion County Coal Resources, Inc., a Delaware
corporation authorized to do business in West Virginia,
with its principal place of business in St. Clairsville,

The object of the above-entitled action, as is more
particularly described in the Complaint filed herein, is to
seek partition by allotment, pursuant to W. Va. Code ยง
37-4-1, et seq., of the coal within and underlying a 2.0
acre tract, more or less, located in Church Taxation
District, Wetzel County, West Virginia.
The Subject Property is described as follows:
Beginning at a white oak, a corner to the “Palmer” grave
year thence S. 20* W. 10 3/4 poles to a stone in the
creek and with the creek N. 82* W 11 poles thence N.
74* W 15 poles to a stone N. 19* E 13 1/2 poles to a
stone above the county road, thence S. 71* E 25 1/2
poles to the place of beginning, containing TWO (2)
acres, more or less, and being an undivided interest in
the same tract or parcel of coal conveyed to J. M. Be
dine by Peter Kennedy and Maria E. Kennedy, his wife,
by Deed dated the July 5, 1916, of record in the Office
of the Clerk of the County Commission of Wetzel
County, West Virginia in Deed Book 54, at page 567
and to which deed reference is hereby made for all
pertinent purposes. The said James M Berdine died
testate on July 10, 1941, and by the terms of his
last will and testament and codicil of record in the Office
of the Clerk of Wetzel County, West Virginia, in Will
Book No. 9, at page 10, he devised the subject
property to his eight children, Daisy Ann Berdine,
Fauchenatis Quipman Berdine, Margaret Abigail
Berdine, Maude Berdine, Mary Lee Berdine, Samuel
Fred Berdine, James Wayman Berdine, and Frank
Lemley Berdine.
It appearing by Affidavit filed in this action that the
Plaintiff has attempted to obtain service of the
Summons and Complaint upon Defendants Calvin
United Presbyterian Church and Bank of Oklahoma,
N.A. of Tulsa, Oklahoma, via the West Virginia
Secretary of State, and upon the remaining Defendants
by certified mail, and that the Plaintiff has used due
diligence, pursuant to Rule 4(e)(1)(C) of the West
Virginia rules of Civil Procedure, to ascertain the
addresses or whereabouts of Defendants; it is therefore
ORDERED that Defendants Dean R. Bradley, Cindy
Bradley, Michael P. Bradley, Dorrance L. Gaft, Charles
W. Keibler, James Read Keibler, Deborah Keibler,

after the date of first publication of this notice,
whichever is later. Otherwise, the Court may render a
judgment of default against said Defendants at any time
thereafter, thereby granting the relief requested by
Plaintiff in the Complaint.
