TRUSTEE’S SALE
OF VALUABLE
PROPERTY
Notice is hereby given that by virtue of that certain Deed of Trust dated October 4, 2004, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1249, at page 224, THOMAS R. OPIC, III and LOGAN B. MOORE did convey unto Laurie Dobkin McDermott, Trustee, certain real property described in said Deed of Trust, securing the holder and beneficiary, Nora M. Murphy, of Wheeling, West Virginia, and default having been made under the aforementioned Deed of Trust, and by virtue of the authority of that certain Deed of Trust, the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale, at public auction, at the front door of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia on
January 6, 2016
at 1:00 p.m.
a certain piece or parcel of land, together with the improvements thereon, and all easements, appurtenances and fixtures thereunto belonging, situate in Wheeling District, Ohio County, West Virginia, to wit: Two parcels of Real Property located at 3 Suncrest Avenue, Wheeling, West Virginia.

At the time of the execution of the said Deed of Trust, the real property was reported to have an address of 3 Suncrest Avenue, Wheeling, WV 26003.

The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases, and other servitudes of record, if any, pertaining to said real property, subject to all matters disclosed by an examination of title, and inspection of the subject real property, subject to any and all unpaid taxes as recorded against said real property, and to any further matters announced at said sale. The real property is sold subject to an accurate survey at purchaser’s expense.

The sale of the foregoing real property will also be made expressly subject to any and all other Deeds of Trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the Deed of Trust referred to hereinabove.

The Trustee reserves the right to adjourn the sale for a time, or from time to time, without further notice by announcement at the time and place of sale described above or any adjournment thereof. The Trustee reserves the right to reject any and all bids.

The subject real property will be sold in a “AS IS” condition. The Trustee will be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Trustee will deliver a Trustee’s Deed to the purchaser, without any covenant or warranty (express or implied), in the form prescribed by W. Va. Code Section 38-1-6. The Trustee makes no representations or warranties regarding the title of the real estate to be conveyed. This is a “BUYER BEWARE” sale and any purchaser is advised to retain legal counsel before the sale. If there is any process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee’s Deed is delivered and recorded. If the Trustee is unable to convey insurable or marketable title to the purchaser for any reason, the purchaser’s sole remedy is the return of the deposit.

TERMS OF SALE: Cash in hand on day of sale or upon terms to be agreed upon between the Trustee and the successful bidder. Proof of financial ability to purchase is required on day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the subject real property, the United States of America would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

In addition to the bid price, the successful bidder will be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the Deed). Additional terms of sale may be announced prior to the sale.

The party secured by the Deed of Trust reserves the right to purchase the property at such sale.
