TRUSTEE’S SALE OF VALUABLE
REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 21, 2007, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 1692452, in Book No. 1326, at Page 131, Erin L. Thalman did convey unto H. Douglas Widney, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated November 6, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Richland District, Ohio County, West Virginia, and more particularly described as follows:
Beginning at a point in the center line of Waddle’s Run Road, said point being located N. 56* 25′ W. 192.8 feet along the said center line of Waddle’s Run Road from the most northerly corner of a 8.582 acre tract conveyed by the Security Trust Company, Trustee, to Grace Conklin, et al, by deed dated October 7, 1938, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book No. 251, page 548; thence from said place of beginning and leaving Waddle’s Run Road S. 49*55′ W. 71.03 feet to a point; thence S. 77* 32′ W. 46.85 feet to a point; thence N. 86* 37′ W. 37.02 feet to a point; thence S. 81* 51′ W. 38.12 feet to a point; thence S. 62* 51′ W. 48.47 feet to a point; thence S. 40* 56′ W. 48.32 feet to a point in the line of the northerly face of the old brick homestead extended in a northeasterly direction, said point being located 58.77 feet from the northeasterly corner of said homestead; thence S. 85* 08′ W. 234.42 feet to a point; thence N. 60* 59′ W. 202.39 feet to a point; thence N. 26* 04′ W. 140.77 feet to a point in the center line of the heretofore mentioned Waddle’s Run Road; thence along the center line of said road with the following eight courses and distances; N. 60*33′ E. 63.71 feet to a point; N. 66* 37′ E. 100.00 feet to a point; N. 88* 02′ E. 100.00 feet to a point; S. 81* 08′ E. 100.00 feet to a point; S. 77* 51′ E. 100.0 feet to a point; S. 73* 56′ E. 100.0 feet to a point; S. 64* 41′ E. 100.00 feet to a point; S. 59* 08′ E. 107.2 feet to the place of beginning, containing 3.237 acres.

Together with all the rights and easements which were conveyed unto Wylie B. Ewing and Elizabeth H. Ewing, his wife, by deed of Security Trust Company, a corporation, Trustee, et al, dated September 11, 1940, and recorded in the aforesaid County Clerk’s office in Deed Book 260, at page 227; and together with all improvements, hereditaments, and appurtenances situated thereon and thereunto belonging.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 128 Waddles Run Rd, Wheeling, WV 26003.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
