PUBLIC HEARING
NOTICE

In accordance with Chapter 8A, Article 5, Section 8 of the Code of West Virginia 2004, as amended, the Berkeley County Planning Commission will hold a public hearing to consider the public comments on the following projects:

REQUEST FOR FINAL PLAT APPROVAL:
Overlook at Riverside, Phase 4, 5 & 6, Lots 24-52, 65-77 & 142-157: The property is located on the east side of Williamsport Pike (US 11) and south of I-81, in the Falling Waters Tax District. The final plat is proposing 58 (42 detached and 16 attached) single-family lots on approximately 10 acres, to be served by public water and sewer.

REQUEST FOR FINAL PLAT APPROVAL:
Middle Creek Vistas- Phase 1, Section 1: The property is located approximately 2500′ south of the intersection of Sailors Way and Strobridge Road (Sec. Rt. 34), with Middle Creek running through the middle of the site, in the Mill Creek Tax District.
The final plat is proposing 10 single-family lots on approximately 16.6 acres, to be served by public
water and sewer.

REQUEST FOR WAIVER:
Riner: The property is
located on the west side of Welltown School Road (WV 9/11); 4000′ south of its intersection with
WV Route 9, in the
Hedgesville Tax District. The developer is requesting a Waiver to Section 504.D that requires “a maximum of four hundred feet (400′) in length” for panhandle lots.

REQUEST FOR MAJOR PLAN CHANGE:
Red Hill: The property is located on the west side of Ridge Road (WV Sec. Rt. 4), in the Hedgesville Tax
District. The Major Plan Change will provide stormwater management facilities to comply with the Berkeley County Storm Water Management Ordinance and meet all MS4 requirements.

The PUBLIC HEARING will be held on Tuesday, June 22, 2021, in the Planning Commission Chambers, 400 West Stephen Street, in the City of Martinsburg at 6:00 p.m. All persons and agencies having an interest on said plats are invited to participate in this hearing and make their comments known by
following the “ORDER RE-OPENING
BERKELEY COUNTY PLANNING
COMMISSION SESSIONS TO THE PUBLIC” enacted June 4th 2020.
A copy of this Order can be found on page two (2) of the Planning
Commission Meeting Read Ahead or can be
obtained by calling 304-264-1963 or emailing staylor@berkeleywv.org. In the event that an
unforeseen circumstance would cause the Planning Commission to cancel the scheduled meeting, a back-up public hearing date of Tuesday, July 6, 2021 will be utilized.
